    ? the 20 year old was driving, the 15 year old was passenger.

    If the 15 year old knew the race was occuring before getting into the car, the charge is unfair. If the 15 year old passenger did not know about the race and the driver decided to do it without regard for the passenger then the charge is fair.

    BTW I am still waiting for a quote from the article that implies the passenger intentionally got in the car for a drag race.
