I never said he shouldn't be held responsible, but first degree vehicular homicide isn't the right charge IMO. I said involuntary manslaughter is what I think he should be charged with. That's why I think the charge isn't fair.

I really doubt the 15 year old was screaming stop or slow down. I was 15 once and I loved a thrill as much as every other young boy. Just sad some people never get the chance to learn from their mistakes.

Charges definitely fit. I dont care who the passenger was or why he was there, the driver is responsible for what happens. If, during the commission of a felony, you kill someone it is murder. Because street racing is not a felony, vehicular homicide fits nicely.

I think its case by case. I'm pretty sure the 15 year old knew that they were going to be in a race. So he should have known the shit that could have happened to him when he's in a car that's street racing.

If the 15 year old knew the race was occuring before getting into the car, the charge is unfair. If the 15 year old passenger did not know about the race and the driver decided to do it without regard for the passenger then the charge is fair.
