Am I wrong to assume that you were there? it sure sounds like it and although it may have been your friends (sounds like it again) you still should of tried to talk them down once the guy hit the ground.

Let me first just say that I am not against you in any way, shape, or form. I just want to inform you of what could happen. In terms of what the law may see, let me make a few corrections...

He can take them to Civil Court and rape him for pain/suffering/injury/etc. Just because he doesn't have criminal charges against him doesn't mean that he can't be found guilty in a civil case. Proof of this? OJ Simpson. Found innocent of the crminal charges, but he was found guilty of the civil charges and lost all of his money. There were MANY witnesses at the scene of this fight. Proving negligence would not be too difficult.

If someone came up and hit me from behind like that (ie, sucker punched) and THEN stomped me in the head, they would be doing their best to live on welfare if I was seriously injured.

I believe since it was "aggravated battery" by 3 counts..... time of 2 years to make a formal charge in criminal court. Also the guy does not have to "press charges". Good question!! The coolness of sueing someone is not just what they have NOW it is what they make LATER as well. THe US Bankrupucy courts also had lots of folks being sued declearing Chapter 11 or 13 to liquidate the civil suit. That practice is VERY hard to get through now, not to mention the criminal aspects of not paying. They no pay they meet Bubba they're new wife with a dick....

A good attorney will file suit against them and anyone leaglly responsable for them. (If they are minors) Normally a crimal case will first prevail then the cvil. It is not likely these guys have the $$ backing as OJ Simpson, who got out of the criminal and got ass raped in the civil.
