    Default umm.. car hit by a tree...

    My uninsured, unregistered, untitled EF hatch has been hit with a tree as it was parked at my apartment complex parking lot.

    the windshield, rear view mirror, and driver's side window were broken.. the roof was also dented.

    Is this a problem i could be reimbursed for these damages through my apartment management?

    I dont really care as I havent invested much in the car.

    but i dont think it's right that they can have a tree fall on my car and not pay for the damage.

    Apartments don't have anything to do with your car. And tree falling down is not their fault, it's god doings.

    the office is closed.. i stopped by after i saw it..

    and they did give me permission to park my car there. knowing it's unregistered, unlicensed and uninsured.

    they should maintain the grounds and take care of any trees that might be about to fall. i wouldnt think a perfectly healthy tree just fell.

    it's not my fault.. if i did have insurance on the car in the first place, i wouldnt go through them either..

    like if someone wants to settle a fender bender without going through insurance to keep rates down.

    i dont think they are liable since in my apartment contract it said that they arent responsible for vehicles parked on property

    they arent responsible for other's actions done to cars.. but when their own property damages something i own, i'd say it's their fault.

    i only check on the car like once a week.. i drove home and noticed the window was down.. thought someone had stolen some shit out of it or something..

    but i drive closer and see a 8 food piece of tree on the ground and a busted windshield and driver's window.

    It's their property yes, but it's your duty yo insure your car. Also, if you had insurance on your apartment, there might be a slight chance they might cover.

    they probably wont give you shit. if it does go throught there insurance or your insurance and there is no proof you even own the car because its "untitled" once they find that out and they will. tell you to get lost! and have a nice day!

    As I have said before, it's not my fault the tree fell on my car. so even if the car were insured, i would not go through my insurance to skyrocket my rates.

    This should be an apartment problem. saftey hazard.

    If my apartment was hit by a tree during a rain storm, leaving the window bashed in and shorting out my television, this would also be a problem for the property manager. poor maintenance = not my fault. I pay 650 a month to live in a safe neighborhood and it's not living up to the normal standards..

    it's not that big of a deal.. i'll bring it up to my apartment manager, if they say they cant or dont want to right the wrong.. i'll just have a dented car i'll be parting out.

    Your car is not insured.

    They don't own the trees.

    Just as if there was a storm and the tree fell down and hit your car.

    a tree on someone's property is part of their property

    property is owned by the apartment.

    dont see your theory of "they dont own the trees" when they DO own the trees.

    A tree limb fell off a neighbors tree and hit our fence and roof, putting a hole in it. They had to pay to fix it (them or their insurance, don't remember which did), because the tree was their property since it was on their property and it should have been trimmed. Apartment property might be different, but I still believe it should be the property owners job to take care of lawn maintenance, because you don't own the lawn they do. Every apt I have lived in, the landlord sends yard people around once a month to do the grass and trim bushes and stuff.

    Just saying this is my personnel experience with it. I would check with someone other than the property owner first just to make sure he don't try to screw you over or tell you its not his fault.
