    Default Apartments' screwing me over!!!!!!!!!!!!

    Well this is kinda long but here it goes: (Any help/ comments are welcome. Family lawyer is on it already)

    I moved in to my apartment on May 07. Apparently the apartments were being sold and a new management was coming in. After I paid my June rent they sent me a letter saying I was late on my rent. "Ok, Ill just call. no big deal". They said they were trying to catch up with all the paperwork and that all I needed was to bring a bank statement. Ok, Statment was taken the next day and that was the end of it.

    July comes up. Paid rent on time and same notice on the door the next day, this time saying I owe both june and July. This time I go into the office and talk to the manager. He gives me the same excuse and that it is just to catch up with all the paperwork. F***er even tries to avoid responsability and make it like I was making a scene. He said nothing would happen and that everything would get fixed.

    Today (7/12), I come home and there is this yellow piece of paper hnging from the door. It is from the Magistrate Court of Fulton County saying that I have to appear in court and pay rent, court costs, late fee and warrant fees. WTF! I go to this f*g's office (for some reason I was a little calmer this time than before). He doesn't give me a straight up answer and pretty much makes it look like I am making a scene again saying that it was all taken care of. It's a Court Order!!!! Obviosuly it wasn't taken care of. I try to the close the door so we can talk and the f***er yells at me telling me not to close the door to his office. WTF again!!! I leave telling him that I will see what the lawyer says about the Court Order and all I get from him is a "Whatever"....

    Has anyone had problems like this one where they live?

    Damn. I say you should get it settled then turn around and sue the complex. Also be sure to check your credit. If it got reported as you being late and it having to go to collections then you took a big hit to your credit score.

The worse part is that when I went before the court order he said" Its just in our records. We will not report anything outside this office" Yeah, whatever! It will be hell for them if it shows up in my credit...

    What management company is this? I'd raise hell w/ the buyers...if anyone in the office is from the old company it'll likely get them fired or it'll at least look pretty bad.

    It was like pulling teeth when things went wrong at my apt. I parked my car in front of my rental office one time in the year I was there and it got broken into. I had a garage the entire time too but was in a rush that day. I went in for days trying to get them to give me the surveillance tape before they told me it didn't work.

    In my last few weeks there my 1 week old G35 got hit by a malfunctioning gate and knowing they wouldn't do crap and I made a huge scene in the office b/c I knew how useless they were. I made sure to yell about how my car got broken into in front of prospective renters and how the gates hadn't worked in 10 months. I think I went on ranting about meth heads and the general delinquents my neighbors were. The management lady had the nerve to suggest the company may pay for it if I would resign for another year. I declined and bugged the hell out of them throughout my checkout process.

    First, were you or were you not late?

    Second, if you weren't, you should have proof (i.e. cancelled checks, bank statement(s)) and therefore you can prove when you paid your rent.

    Third, hindsight is always 20/20, so next time get everything agreed to IN WRITTING. Don't settle for "it'll be aight..." because as you can see it can bite you in the behind. If they won't give it to you in writting, you know they're up to no good.

    Finally, you have a set amount of time to respond to the dispossesory notice. Dispute it and explain briefly why. Return it and wait for a court date. In the meantime, be sure you pay your future rents on time no matter what until you get your day in court.

    You may also try to go over Mgmt's head to corporate if there is such a thing in that company.

    1. Rent has always been on time. Its always been dropped off during office hours.

    2. Already showed them statements, even before the court order was filed. I have copies of the checks and statements that I am taking to the court today.

    3. I know about getting everything in writting. Its just that never have I had a problem before and this is like my 4th apartment. Lesson learned!

    4. The note says to show up in court before 7 days after the note was delivered. Im going today.

    5. I contacted the head office (which happens to be in Atlanta). Told them the situation and left a message for one of the general managers to contact me ASAP. Poor secretary had to be on the phone with me for a long while I explained the whole situatiion.

    Actually it is the new company the one thats managing the complex right now. They are the ones screwing up. However, the court order came under the name of the old company (assuming their transaction is not done yet) so I contacted their head office. Waiting for dude's call....Still going to answer to the notice today.

    somebody had to cash the checks. find out who from your bank and take the info with you to court. you might win but will probably still end up paying court fees.

    you then take the management company to small claims for loss wages(missed work),bad credit(cost to fix credit),court cost....get your HARD(paperwork) evidence. and be nice to the judge and youll get all your money back.

    Yeah it sucks to have to go to court but Im plannin on getting everything back.

    I would start sending your rent checks certified so you know who is signing for them.

    my apartment complex tried to do that shit to me.. but never got to court.. but whenever I turn in rent I got a RECEIPT by them.. to prove the date and all I paid..
