Okay I'm kind of 50/50 on this, but that's why I'm asking. Any insight is appreciated.
I'm not sure if I should just pay the ticket or go to court and try for a lesser fine/points.
As few of you know I got into an accident last month on the 16th while driving in Sandy Springs.
My story is as follows...
I was driving through at about 35mph and down towards an intersection. I'm still traveling at the same speed the light is green.
Before crossing the intersection the light turns yellow. Someone turns left in front of me and I lift off the gas, ready to brake. I won't be able to brake in time...so I gased it to pass while still yellow. A lady in a Volvo turns in front of me, I try to brake. Not fast enough. So an accident happens.
We both are cited for "failure to obey traffic device"
Mainly due to the witness' point of view. But her statement doesn't agree with either of ours. She said we both ran a red, which is false. I believe that she saw her light as green after the impact.
The driver that turned left said that she had a green arrow. I have video that it's cycle is green arrow > green light > yellow light > red light.
Questions raised as follows:
Am I in the wrong for running yellow? (did not turn red)
Is she in the wrong wrong for failure to yeild?
Can I get away with a lesser fine/points?
Should I go to court?
Should I just pay and forget about it?
