no he isnt in the car seen,he was driving and topped a hill where the boy(austin) was ridin his bike in the road....he slammed on the brake and struke him....my dad(fireman)said that when they loaded him in the ambulance that he wasnt breathing and that he passed away on arrival or within a couple of minutes in the hospital
