Guess what, if you buy a used car and the test drive goes fine... you can STILL get maintenace from the dealer if it is in a short period of time. Whether he signed a contract, called his mom, wiped his ass, kissed his girfriend or not... the "trade" was NOT complete if he didn't get home. It does not take a genius to know that. Hell we could argue ANY point to dilute what the REAL problem is... we could sit here and argue for 3 hoursthat he didn't get a Carfax report and that would mean NOTHING b/c that has no bearing on the clutch problem --> JUST like arguing what the OBLIGATION is has no bearing. Tell ya what Miranda... go buy a plane ticket from Atlanta to New York. For shits and giggles, we'll say the plane has problems --> let's just say the CLUTCH went out and the plane is forced to land in DC. The airline tells you that it's YOUR responsibilty to get yourself to New York. I mean you DID do the research to make sure you were on the correct plane... so it's your OWN fault right Miranda? You should have flew that particular plane to NY ahead of time to make sure that it would make it the whole way.
Look... we are not saying the AC went out. We are not saying the taillights do not work. We are not saying that the sunroof leaks. A MAJOR portion of the cars driveline took a dump before the car made it 50 miles under normal driving operation... deal or no deal that's CRAP --> used or new, trade or cash, there is no way to slice it he needs to trade the cars back. At the VERY minimum definition of the word, and all other creature comforts aside, a CAR is something that should get you from point a to point B. They traded CARS, and 1 of those cars did not hold up to the definition of what a car is, and what a car does.
