umm not sure.. but i think its that once u get served (get papers) u have 30 days to repond to the courts. if you pay him off in ful before that make sure to have a notarized letter and/or proof of payment.. just go to Kroger's customer service desk one day with a typed up letter stating everything. and sign off on it infront of the kroger manager and they will notarize it for u.
You have 30 days to respond to the initial accusation. That would be your opportunity to file some sort of motion with the courts. If you do not respond, (response meaning "anything-I hate him Im not paying-I was shot in the chest preventing me from paying him- I don't owe him......blah blah blah.) I think you have the option to wait up to 45 days, however, you have to pay a court fee for the extension.

ahah, i filed one of those before... but it was becuase the guy litereally tried getting out of the contract, none of the bs 2.0 is pulling on you. the guy got scared, payed me, and it was all over with. we went in on the court day and we said things were resolved.

Think about it, Jan. and it is now almost june and he has made one payment. The Judge is going to look at it the same way, not to mention that I have three eyewitnesses to his lies. For instance he calls at 11 p.m. and says "Yo, Rob I have the money, I am on my way home and then I am going to come over and pay you. I then get out of bed and get ready, only to get stood up. This is after he has been saying for 5 days I have the money, I am just busy right now, I will give it to you when I go by my house. LOL, how would you feel after 4 months of that crap. Just think about it. Then he tells me that we are going to settle it out of court, like he can make me do what he wants, after I have had to go to file and pay money, take time off work etc. But that he is only going to pay me after he gets served, lol he owes the money anyway, then he has been served, guess what still not a finger lifted to even call me. I wish the thread was locked. This bull anyway.

If the lawyer would be that good. He probably would not even take a second glance at the thought, unless Benefit had a huge retainer to pay the attorney. I would think it would also be difficult to prove all of the other things to a significant amount of damage relating to the claim.

You say you've got the money, the seller even gave you multiple deadlines to pay the money (page 4 & 5), yet you've posted some BS reasons - banks are closed, not at home etc. 2.0 says you made 1 payment, yet you mention 3? Unless there are any receipts or witnesses, you don't stand a chance in hell to prove that you actually made 3 payments.
If you really did have the money, why the **** didn't YOU suggest a date and meeting place, pay off the money and set things straight? You just come across as a lazy ass bastard. In business dealings, you gotta to be proactive and not reactive.

You should have notarized the bill of sale or at the very least, drawn up a *proper* BoS. If the OP was ready to pay off the amount, why didn't you set a time and date, call a neutral person (someone from IA and not your/his best friend) and set things straight? Early on in the thread, you said you didn't want to resort to name calling and other crap, yet you kept posting rather than going about the proper way of repairing a deal gone bad. I have actually been willing to take the pay off, before this thread was even started and have tried to get him to pay as of recently. Thank you for your input, but nothing more that I can think of is needed from you at this time. Just for the record, the only time I have refused payment before I filed with the courts, was when he was supposed to pay me days, if not a week before and he calls me after 11 p.m. on a week night and says " I know I am a lil' late, but I can meet you in a lil over an hour". Would you get out of bed at midnight and go meet someone who was already b.s. ing you for a week on a payment? No, I didn't think so. BTW, if this offends you really badly, just ban me before you rant on anymore. Thank you.
