    Default Speeding ticket Question

    I got a speeding ticket today, I was going 48 in a 35. The cop said that he clocked me going 48 going downhill, my question is does he suppose to show me that he clocked me at that speed or just say it? Is there a way I can fight it? I hate that my insurance will go up and it was in Doraville

    Really is this a law? He wasn't visible either, he was in the dark and he even said it himself that he clocked me going downhill.

    I don't know if dark will cover it. I think he's gotta be behind something or behind a hill. You need to take pics of where he was sitting.

    Why would you insurance go up? LOL the ticket is 13 over. Won't go on your record. It's just a fine.

    I just thought that it will go up for that reason, my driving history isnt exactly something Im proud of. Don't tickets show up when a cop pulls up your driving record?

    The correct answer is that yes, your ticket will show up on your record. It just won't be worth any points (depending on your age, I think). So the insurance company can see it. At thirteen miles over, it's close to the normal fifteen and they may up it.

    Not necessarily true. Insurance tends to climb until you reach 25. THAT is when they start considering you a more mature adult. But it still won't stop premiums from going up if you keep getting tickets.

    The ticket will not go on your driving record, therefore insurance will not be able to see it. Your insurance won't be affected by a 13mph over speeding ticket. Go to the court and ask.

    Unless they changed things it should not show up on your record. 14 and under is a local violation and is not reported to the state

    A moving violation is a moving violation and will go on your record. If fifteen miles per hour and under, it will reflect that as no points towards your total. Now the judge can throw it out by changing it to another charge that will not be a moving violation to keep it off your record.

    QD is correct - It will go on your record with no points, and insurance will be able to see it. Furthermore if you are under 21 which it sounds like OP is, insurance will go up. Not right away, but when the policy renewal comes around they have another ticket to negotiate in there.

    OP sounds like you are not denying that you were speeding 48 in a 35 - Just trying to sneak the ticket off. My advice is show up to the court hearing, everytime I've done that they decrease the speed and the fine = win / win, just for showing up and taking some initiative. Take responsibility for your actions, pay the fine and don't do 48 in a 35.

    I got out of one where the grade was less than 7%, cop tried to claim he was far enough away from the hill. I made the hill look steeper than it was with pics and surveyed the area. Judge gave me the W.

    Hey, if you can make it work why not? I'm sure some judges are more lenient on that law than others, especially if you can make it appear steeper than it is.

    Im 23 by the way and I dont mind paying the fine its just that I already pay a lot for insurance. Allstate doesnt forgives on tickets.

    A local ordinance violation does not show up on DDS record IIRC. I've gotten a few things that I have had changed to such and they were not present when I requested a 5-year MVR (they were definitely within the 5 years when I did so).

    Ordinances don't, but speeding is criminal in GA.

    That's what Mike was getting at. A lot of times, judges will change the speeding violation to a local ordinance (city misdemeanor) to help keep a person's driving record cleaner. Most of the time, as long as you can pay the entire amount of the fine, that's what the judge will do.

    Bingo.

    Trust me, I've been playing "in the system" for too long lol...I've learned enough to know what to do. But like all things, nothing is guaranteed. Even with the knowledge I have gained, there are times where they will not do anything to reduce the ticket. In court, your dress, you atitude and your ability to use the English language go a long way in working with the solicitor/prosecutor.

    Never had to before, but clicking the links keeps prompting me to now for some reason. Go here and search for 40-14-7 and 40-14-9 at the top of the page and you should be able to find them.

    It just sucks when officers pull out random numbers out of their ass for a speeding ticket. I know my first one (and the only time I've used no-lo) was right after I got my license. I was on Oak Rd. in Snellville and pulled out of a neighborhood on a downhill and goosed it a bit and came to a stop less than 1/4 mi down the road for a car turning left. When I stopped, I noticed a GCPD behind me and as soon as we started going he popped me. He claimed that he was coming down the road when I pulled out and that he "had to do 80mph to catch up to me and you were pulling away from me". Total bullshit. Anyone who has driven a Jeep Wrangler (even with the 4.0L) knows they are a parachute with wheels and won't go 0-80-0 in a 1/4 mile and come to a safe stop. So he gave me 80 in a 40. I later saw the posted speed limit on the road was 45, further proving that asshat was just being a dick and didn't care about what he was doing other than writing a ticket. In the years I have gotten tickets and have learned the system and dealt with cops, I look back and see how much bullshit that ticket was and how I could have fought it. But I was young and dumb and hired a lawyer to negotiate with the court. Paid a $350 fine, took DD class and paid the lawyer $250. Did it all on my own without my parents finding out...until a friend of a friend of my neighbor was talking to my mom and somehow found out. I was surprised I didn't get in trouble...my parents actually commended me on handling my own shit like an adult and taking responsibility...though they weren't happy that I did it in the first place. But still, cops sometime do pull shit out of their asses...and if you know it, you can fight it easier. But that was my story about using no-lo...because it was definitely helpful in a situation like that.

    Hell, I still speed 10-15 over or go a little faster than the flow of traffic because I find that going a bit faster than other cars on multi-lane roads give me more control of where I am and is safer. I don't just haul ass everywhere though. But like many of us here, I still "get on it" on occasion for a bit of fun...when no one is around.

    I hate when they try to pull that shit. I just tell em if they were stopped, then neither one of us is exempt from the laws of physics. Doesn't really prove how fast YOU were going at all.
