I would think that it is his fault because he was drunk and shouldn't even be there in the first place. So what should have happend is you should have accidentally rear-ended air, which as far as I know is not a crime.

I agree, because if some one hits you and you dont have insurance, its your fault because you were not supposed to be on the road in the first place. The same should apply in your case, but Im no expert.
