Also.. The example you gave, is wrong. Even as just an example, thats not how it went down.
This situation happened as so..
Guy calls me. Wants to see the car. Guy says that he has cash, and car will be purchased when he comes up here. Guy comes up here, takes car for a test drive. Says he has to come back to pay. He was told that the radiator was not to be included with the purchase of the car.
Talked over the phone, guy wanted the radiator. He said that if I left it in, he could pay the 300 at the end of the week, about 3 days later.
Guy comes back the next day with cash in hand. Total is 1800, but I didn't have another radiator to subsitute, so I trusted he was going to come back with the cash.
He still owed/owes 300 for the radiator. The total with the radiator was 2100. He knew this, and decided to stiff me.
Doesn't seem like the same situation to me.

Point is the guy knows that the radiator wasn't part of the "As-Is". I was nice to him, to let him drive off with a 300 radiator, hoping he wasn't a theif.
