Good question and that answer varies. A judge "could" rule someone to be "judgement proof". That means that you are technically exempt from having a judgement against you. There are rules and such, but that is the gist of it. You need to be in a VERY serious financial situation for that to happen, though.

Otherwise, you can go after salary, wages, assets, etc. Perhaps he is ordered to make payments; it could be any number of combinations.

I mean there are no rules in street fighting, or in fighting at all. Theres no referee thats going to blow a whistle because you kicked someone while he was on the ground. its no holds barred.

Now ive been in a couple fights where i had the dude on the ground and kicked him in the stomach or in the face, only becuase i know if i was on the ground he would probaly kick me in the face or stomach. If i fight you, im going to do whatever in my power to fuck you up and if were fighting theres nothing you can do to talk or negotiate the situation because we wouldnt of been fighting in the first place.

For those people that say "oh it wrong to kick someone while there down" i can tell have not been in many street fights or have probaly gotten whooped and kicked to the ground.

No, you are missing the point. The bill states that me, as a 3rd party, can come to the defense of someone that I see in serious trouble. What that means is that if you start beating someone down like this, you could have some of the crowd members pulling guns on you with the intent to shoot. We will have the ability (if the bill is signed) to protect citizens as well. Keep that in mind...

Let's say that you hit someone from behind (sucker punch), they fall to the ground, and then you start kicking them in the head. If I witness this (the person is walking way and you are the aggressor that is chasing him down and sucker punching him), I will act accordingly to defend the safety/life of this person that I don't even know. Don't be surprised if a bullet rips through your chest as you are beating this guy into a coma. It will be situation dependent (ie, if he hits you first, then you are in your right to defend yourself) of course. If someone attacks someone from behind as they are walking way (they are no longer a threat), then that person is the aggressor in the situation and is subject to this law.

That law mainly applies to yourself or a family member. The point of this new law (if signed in) will allow for that to be broadened.

I like ruiner believe the same thing. If someone is going to cause serious bodily harm or death to someone else, they are going to get confronted with a gun. The key part of this and the way the courts will interpet it is if forewarning was giving.

Same senerio as Ruiners:
Some guy beating the life out of another, I pull a gun and say "stop, your going to seriously hurt him", dude does one of the following

1. doesn't stop or
2. Stupid enough to believe I won't shoot him.
3. Comes after me.

Solution : KABLAMM x 3.

4. Guy comes to grips calms down.

The same would hold true if the guy being beat got up grabed a tire iron and tried to go after the 1st dude.

The key to all this is to stop the fighting.

I believe the law lawmakers believe this is a good solution to keep the attackers, beaters, sucker punchers, what have you in check. If they do not value others lives then they risk having their own life taken in the defense of the person they are hurting. Make sense to me.
