What I find funny is Vr6 stating they guy on the bike could have been seriosuly injured. Only way that would have happened is if the dumbass was flying through the parking lot. Otherwise he would have just dropped the bike with no harm what so ever to him. It is obvious at this point that these guys are your friends, do the right thing and give the names to the police.

Correct me if I am wrong, but the guy who was beating, WAS NOT the one who made the guy dump the bike...... He just had a loose mouth.....

I am reminded of a post that included a sentence (a partial one at that) that contained a reference to backing up any talk that someone does. Hmmmm. Where was that? Oh wait. I remember where. Here it is \/ \/ \/:

No it couldn't, at 5 to 10 and the brakes on a bike the worst that would have happened was he fell over with the bike thats it. Now speeding or showing off then yes it could have been worse. Point is you are defending "friends" that took something too far for no good reason but to prove to their "homies" they were hard. Dude hit the ground the fight was over, to carry it any further was uncalled for and they should pay severly for it.

The guy that got beatdown by your friends was not even the guy who stepped in front of the bike. So this was clearly an ego thing that got out of hand proving a point.

Proof of this? OJ Simpson. Found innocent of the crminal charges, but he was found guilty of the civil charges and lost all of his money. There were MANY witnesses at the scene of this fight. Proving negligence would not be too difficult.

If someone came up and hit me from behind like that (ie, sucker punched) and THEN stomped me in the head, they would be doing their best to live on welfare if I was seriously injured.

Don't be so naive to believe that someone can't have charges brought against them days later. The Statute of Limitations is far from over for this case. It's rather easy to make a case in the eyes of the law: If someone is no longer a threat and you pursue them, especially from behind, then YOU are the aggressor (the guy(s) that went after the person who was walking away). The law does not look favorably upon aggressors in situations such as this (assuming what I have read is accurate).
great point, although i do have a question (and have had it before) that once again popped into my head. if you sue someone in civil court, and it turns out they're pretty much a deadbeat, what money could you sue for??? just wondering, not trying to be smart ass.

Good question!! The coolness of sueing someone is not just what they have NOW it is what they make LATER as well. THe US Bankrupucy courts also had lots of folks being sued declearing Chapter 11 or 13 to liquidate the civil suit. That practice is VERY hard to get through now, not to mention the criminal aspects of not paying. They no pay they meet Bubba they're new wife with a dick....

A good attorney will file suit against them and anyone leaglly responsable for them. (If they are minors) Normally a crimal case will first prevail then the cvil. It is not likely these guys have the $$ backing as OJ Simpson, who got out of the criminal and got ass raped in the civil.

Good question and that answer varies. A judge "could" rule someone to be "judgement proof". That means that you are technically exempt from having a judgement against you. There are rules and such, but that is the gist of it. You need to be in a VERY serious financial situation for that to happen, though.

Otherwise, you can go after salary, wages, assets, etc. Perhaps he is ordered to make payments; it could be any number of combinations.
