Let me first just say that I am not against you in any way, shape, or form. I just want to inform you of what could happen. In terms of what the law may see, let me make a few corrections...

That's now how the law works. He doesn't even have to press criminal charges. He can take them to Civil Court and rape him for pain/suffering/injury/etc. Just because he doesn't have criminal charges against him doesn't mean that he can't be found guilty in a civil case. Proof of this? OJ Simpson. Found innocent of the crminal charges, but he was found guilty of the civil charges and lost all of his money. There were MANY witnesses at the scene of this fight. Proving negligence would not be too difficult.

If someone came up and hit me from behind like that (ie, sucker punched) and THEN stomped me in the head, they would be doing their best to live on welfare if I was seriously injured.

Don't be so naive to believe that someone can't have charges brought against them days later. The Statute of Limitations is far from over for this case. It's rather easy to make a case in the eyes of the law: If someone is no longer a threat and you pursue them, especially from behind, then YOU are the aggressor (the guy(s) that went after the person who was walking away). The law does not look favorably upon aggressors in situations such as this (assuming what I have read is accurate).
