    Default Fucking shit, car I just bought is a goddamn lemon ( lemon law help? )

    I know GA's lemon law doesn't really apply to used cars, but bought a Subaru Legacy SUS off of CL. Had a few minor issues, nothing to be unexpected.

    Driving it this AM to work, car overheats. The fuck? Check the rad, it's... empty?

    ... fuck.

    Later today I went to All Pro, Brandon yanked the thermostat - and yup - rigged to stay open. Car has blown head gaskets

    I ask because while I bought it off of CL, the guy... gets cars fomr charities and blah blah, anyways, he's actually a dealer ( according to the bill of sale and title ).

    Any basis here? Already sent the guy a text being uh, look it'd really behoove you to get the cars fully inspected because while we knew this thing had water in the radiator, it has blown headgaskets ( see if I can resolve this outside of court, but... if push comes to shove )

    I've done headgaskets on 3 of these in the last 2 weeks.. sucks hope you get it resolved

    Would a dealer still be counted as private party on the bill of sale/title?

    Still says Sold As Is/No Warranty though on the BOS

    Your screwed period . Sorry but it is what it is. Good news scrap is paying a lot just playing man shit sucks but it happens everyday . All craigslist is is a site to sell your car when it starts messing up .

    Cool news is the seller is, according to him, thinking of a way to resolve this so that we're both happy.

    I should just tell him pay at least for some of the repairs and I'm cool.

    I wouldn't tell him anything. If he willing forks out any cash or help, he's doing more than he's legally bound to do.

    I work in the car business. Piece of advice. When buying a used car ALWAYS have it checked out. Take a look at your bill of sale and see if theres any room to possibly file a small claims suit. Most used cars are sold as is with no warranty and have a clause in the contract saying that. When I sold my Scion a few months back I made sure to put a clause in the bill of sale like that to protect my ass legally from someone trying to pull something over on me.

    Sorry this happened but shit happens unfortunately. Hope everything works out for you.

    I disagree with this. If you bought the car from a semi reputable dealer, you should just explain what you and your mechanic have found what it's going to take to fix it and let him know up front that your not expecting him to pay for the whole thing but helping in anyway would be greatly appreciated.

    yea the seller should help
    i bought a 06 mazda 6s
    started knocking after driving for 6K miles for no apparent reason.
    dealer bought it back for 75% of the price

    have the seller pay for atleast most of the cost to get these gaskets replaced!

    You obviously didn't read very thoroughly. Their bill of sale said "AS IS, NO WARRANTY" on a used vehicle, sold as a private sale. Meaning, he is legally not bound to any repairs, reimbursement, or rentals (etc).


    Just like when you sold your Scion and stated the same coverage. At any point if the buyer of your Scion came back with a blown headgasket asking or demanding any type of help, you can tell him good luck with everything, don't let the door hit you on the way out. My point is, he's saying he should "TELL" the seller what he needs to do for him, instead of being gracious of any help that was offered.

    if he is a DEALER, like a legit dealer, then lemon law can apply. If hes a private seller, its your responsibility to have the car checked out, and once you pay for it, its yours.

    Doesnt matter what the bill of sale says, if he doesnt have a business license, you cannot go after him for lemon law.

    Lemon laws only apply to new vehicles no used vehicles.

    I don't know GA's rule, but in SC it's only for new cars.

    LOL. Fuck you. LOL. Nah I read it and understood it completely. My argument was simply that if it is a halfway reputable dealer, if you go to them and say "Hey look, I understand I bought a vehicle as is and that legally you guys aren't bound to do anything. However, after taking delivery within (insert time frame) XYZ has gone wrong with the car and I was wondering if you guys would be willing to help with some of the repairs. Not ALL, but SOME." With the economy the way it is and used car deals becoming harder and harder, dealers are more willing than ever to go above and beyond the call of duty to keep a car in the streets. Believe me we have it happen every so often. We sold awhile back an 07 SS Trailblazer with 100K miles on it and within a couple of days the transmission in it took a dump. It wouldn't go into second. We asked them to cover transport cost and paid most of the cost of replacing the transmission. Everyone walked away happy.
