How are they allowed to bring forth a trial? Does anyone know?

You dont have to be a US citizen to file a civil suit in American courts. You only have to have council that is licensed to work in the state and file the suit in the correct juristiction. Once those 2 criteria are met, it becomes a question of interpretation, which is something that no one can predict. The sad thing is that this rancher is goingo have to spend a huge sum of money to defend himself against this, even though 99% of sane Americans would see it for what it is, a frivilous lawsuit.

Damn, I learned something new. I am guessing that there is no way to toss the case if it makes NO FREAKING SENSE? After this, the rancher is not going to be happy. The next illegals may not be so lucky to just get turned over at gun point.

The US BAR or the legislature needs to enact some type of law against frivilous lawsuits. These types of suits are getting more and more common as people are winning them. Eventually there needs to be some common sense law enacted to shield people and companies from the huge defense costs. The problem is, no one in congress would EVER be willing do this because it will be called an attack against people in their fight against corporations that are out to abuse them.
