I doubt you could even estimate was his BAC is, nor do you know how much even being 'buzzed' can affect one's driving.

If he'd driven off, crossed a yellow line somewhere and got pulled over? He'd be in a whole lot more trouble now.

I'm willing to bet that -most- DUI related incidents occur because the driver thought he was 'just buzzed' and decided to drive.

I understand what you're saying about getting what he deserved, but given what you've told us about the situation, the police did have probable cause, and it's good that they did, because he was breaking several laws (some potentially harmful to others) to begin with.
