no, thats only a moving violation. if you are over 18, you cannot get more than 4 points at once, but you can accumulate over 4 in different times...
if you are under 18, you cannot accumulate over 4 points at any time.
that is only a moving violation, its only 3 points...
unless you are at 12 points already... then yes he wouldve said something.
