    Default Legality Question

    If someone signs a bill of sale to their car to waiver their debt. Then goes and hides the car so it does not get repoed. Is that a criminal act of any sort on their behalf?

    The guy has signed the bill of sale that states the transfer of ownership of the vehicle to the new owner to void the total amount of $XXXX previously owed to new owner.

    The guy owes two people $4900 (for 1year and 4 months). Only thing of value he has is a 15 year old non running car. Guy signs the bill of sale friday, says he needs to get some stuff out of the car monday once he gets back from out of town. The two guys go monday to tow the car away only to find that the guy over the weekend has towed it away and hid it so it would not get legaly repo'd.

    So if the guy does not own the car anymore wouldnt he be commiting GTA? Should the two guys contact the Police?

    the way i understand it,the minute they signed the bill of sale the car changed possession, so it's no longer his car to hide, he's hiding their car.

    the two can either call the cops or sue i guess. there's no doubt about it. it's illegal.

    The two would not sue since it would take his broke ass too long to pay them back. But the two will go to the police department tomorrow or the day after, repo the car and press charges depending on mood. Anyway +1 to all

    also, I belive your friend has the right to call the police and tell them what happened

    Voya.. I don't know that a police officer will want to touch that. Since these two guys did not witness the removal of the vehicle from the property, he could say anything and there's no way to prove what happened.

    Your friends' best chances are going to be a civil suit in magisrtate court for breach of contract.

    In criminal court, the standard of proof is beyond a reasonable doubt.

    In civil court, your friends need only meet the standard of 'by proponderence of the evidence.' which is much more flexible. If they can get his social security number, they can have the guy's wages docked.
