You beat me to it. Correct, that IS NOT a real H&K MP5. It is a clone, but nothing more. Typically they run around $1500 or so for the semi-auto clones. If this one, indeed, has the ability to go full auto if the plate is removed, then I would surmise that it breaks federal law. Not state, but federal. That means that you go to federal pound me in the ass prison if you get busted with it. You are playing with fire...it's only a matter of time before you get burned I assure you.
