    but just a factoid, the President can declare war, He can say he is going to war with pretty much whoever he wants whether or not it was up to the framers to intend it that way.


    The president has the utmost authority to declare war when in defending the country from an attack. The only thing is that Congress must sign off on giving him an army.

    he has to get approval from congress first

    What may be in the Consitution has changed now. The Presidential Powers have definately expanded

    I think that might just be an official thing they do afterwards, the president has the first say and the damage is already done afterwards.
