1. You said the cop put down that you were racing? Your insurance probably won't cover it, his probably won't either. So you are going to have to sue him whether you want to or not.

Hmm. i dont know what insurance company you work for, but yes they will cover it, as long as the race didnt take place on a track like commerce or road atlanta you would be covered!!!
I have seen more then a few of these claims come thru my office and each and everyone was covered!!!

the question is, what company will cover the accident yours or his.More then likely yours will pay for your car and his will cover his car.
