funny thing is, the car sat here for weeks without any problems. He took it for a week or so and dropped it back off last night and between then and when we opened this morning it happened. They didn't touch anyone elses cars. It doesn't look like they even tried to touch anyone else's cars.

There was damage on his car, but they didn't even break in the windows or anything. The only damage was caused from them taking the wheels off on the drivers side front quarter panel and the drivers side side skirt. Other than that the car is fine. Wierd!

I don't really get it. I think it was random. Either way, the car is inside now (and so are most of the rest of them).

Lucky for us we've been open 4.5 years with no issues like this. I think we are lucky for that.

    I'm sorry this happened

i know tracy... i could tell by the loss of words from everyone...

it just doesn't make sense... whoever it was knew my car was there and took what they wanted.. so sad we live in a society where people just take things they don't deserve nor worked for... i work 70 hours a week to buy the things i want and others just take 15 minutes to steal what i worked hard for.... its really f'in pathetic!!

if this were the first time something bad has happened to my car, i would brush it off as a learning experience... but now, i gotta start thinking whether or not to keep up this hobby.... this really sucks to say the least.

Maybe 3 times is a charm OK so that doesn't help. Maybe this will. It'll be fast once we're done with it

    ps. speedmonkey says hi. xoxoxo

ps ps. as much as i've disliked you from the beginning... even Dan can attest to that... cuz i told him so when i first came there and met you... i can honestly say i've kept a tight lip.. .dont know what you've heard, dont really care... but in my eyes... i've been more than fair about our situation.

but you have to always have a big ass mouth and run it all the damn time. they can close that last thread where we tore you apart and then you and dan (sorry dan, i still like you, but u need better taste in women and business partners) go and make FOOLS of yourselves going off about the wrong damn oil pump!! LMFAO..... but you crossed the line when you insinuated i stole my own wheels. thats just FUCKED UP!

you think i dont have eyes and ears all over the place? i know alot more then you think i do... this is far from over.... i was gonna let bygones be bygones and take my losses.... guess thats not gonna happen anymore...

the only good thing is that i would have had to buy new tires soon, so that would basically cover my $1,000 deductible...

and yeah, the damage wasn't too extensive considering... could have been alot worse... but for stealing just wheels and tires.... the drivers side fender needs to be replaced. the drivers side skirt is jacked up. theres a crease in the drivers door... a dent in the passenger fender and a nice sized foot print along with the front bumper not aligning well anymore...

thats quite a bit of damage for taking wheels. i just hope my insurance co. pays for my wheels/tires...

from the sound of things he had dropped his car off at night after the business was closed, which would leave the owner liable. the only way a shop can truly be held liable for this is if it's locked inside and it happens, or if you can prove negligence on their part for leaving it outside, which clearly wasn't the case here.

hmm yeah if thats the case then yeah but if the shop excepted the car that means it was in there care at the time of the incident but like i said i dont know if the wants ill definitly find out for him but when i drop my car off at a shop i sign some paperwork which puts the shop liable but i dont know law crap so you might be right man

i dropped the car off before they closed. it was sitting within their premises with 2 sets of fences surrounding it. i honestly don't know if i can hold them liable. i would ofcourse love to not have to pay out of my own pocket for this incident, but it seems that might be inevitable.

ill check on that for you man cause if you left it with them and they acknowledged that "for example the knew they was gonna be doin work to the car" then it was there responsiblilty to provide security for your vehicle ill look into this id ask your insurance claims adjustor also

but in bg's defense.. they have you sign a preliminary invoice which states in small print that your car must be insured and they will not be held responsible for any theft, damage...etc... thats not word for word but regardless.. i signed it w/o reading the small print..

I believe they still have to provide "reasonable" security though. It is not that they can just wash their hands on the matter. If it were so, an employee can just jack your shit and then say "read the fine print, buddy"... It all depends on the circumstances though.

Same thing with Valet parking. Even though it says they are not liable for damage to cars etc, if the Valet does not provide REASONABLE care, and just decide to peel out and sideswipe your rims, or back up into your car, they still have to cover for their mistakes.

I have had both happen to me in the past and on both account I was able to get SOMETHING back.. of course it all depends on the case itself. I would just look into it. Worst thing is that you just pay your deductible and plead to your insurance company on your knees to not raise your rates. Sometimes it helps.

There is reasonable security. 2 locked gates. He actually asked right before he left if it would be inside the 2nd set of lacked gates and we said yes. All of the customers are well aware that their car will be stored outside. We don't ask customers to drop their cars off here until we are ready to work on them. In fact, they usually plead with us to drop it off early "incase we can get started on it". There are several reasons we do not encourage people to drop their cars off before we are ready, theft being one of them, not enough space to store all of the cars on on 3 month waiting list and when people drop their cars off before we are ready to work on them, they have a false sense of how long the car has actually taken to work on because they left it here before we were ready. We never lead anyone to believe otherwise as far as where their cars will be stored or when they will be worked on.

Anything that I mentioned above is not directed toward or about any customer in particular. So don't take it personally anyone please .

We made the waiver becuase we were informed to by our attorney years ago. The print is font size 9...not that small

Like I said, I'm sorry that this happened. Luckily for us this is the first time that anything like this has happened at either one of our shops.

I think that after being open for almost 5 years without incident and the same employees since the beginning...we are trustworthy. He is getting the hook up. Don't you worry about that. He was getting the hook up before this happened. I'm sure he will attest to that. His car is still here. It seems like you are more worried about this than he is. I'm sure he appreciates your sympathy tho

So what are your suggestions? I'll gladly take them into consideration. I tell the customers where their car will be stored, I tell them when it will be worked on, we never suggest a person bring their car until we are ready to work on it and finally....we have a waiver drawn up by my attorney that all of the customers sign stating (I'll cut and paste for you) "I hereby authorize the above work to be done along with the necessary material and hereby grant you and/or Batlground's employees permission to operate the vehicle herein described on the street, highways or elsewhere for the purpose of testing and/or inspection. I also acknowledge that Batlground requires that I carry insurance for my own car. By signing this, I agree that I and/or my insurance will be held responsible for any damage to the car itself or its contents, including fire, theft or vanadalism." I think we covered all of our bases incase an incident like this ever happened. Our attorney seems to think so

i don't think a shop should be held accountable for theft (unless of course the shop is the theif). the shop doesn't say, hey, i think a theif should come steal some stuff today. it just happens and its not somethign that can be controlled.

yeah.. im not mad at bg... if i had asked for my car to be parked inside the shop and they didn't, i would be furious, but that wasn't the case. im more upset at myself for not reading the small print.. if i had read it, i would have only left my car there if they promised to keep it indoors at night which is where its being kept now.

i don't expect bg to help out with this situation more than they already have... but ofcourse, since this is the first time anything like this has happened at their shop, it would be nice if they offered to help out with my deductible seeing that i've spent a decent amount of money with them in a short period. that would definitely show some major customer support and appreciation in such a terrible situation as this....

I understand. But the money you spent was because another shop messed up your car, true? but that's neither here nor there right now (except for the fact being brought up about how much money you spent here). You're getting a deal already whether you realize it or not. And I'm not trying to throw that in your face. It's just to hope that you understand that Dan spent a lot more time on your car then was charged. Dan usually short changes himself since he doesn't have to pay a tech when he works on the car. There was no way that anyone besides Dan would have been able to sort out the mess going on.

Unfortunately, we don't make as much money as I think everyone thinks we do. If we have to worry about paying for things that may happen like this, then we have to raise our rates to be able to come out of pocket incase of things like this. Right now we just make enought to cover our bills most of the time. Don't think that because we have a few fast cars that we are balling out of control. The cars are a necessary evil for the advertising of the shop. We do what we can to cover our behinds and I think we did in this case. Don't get me wrong, I would love to have the 2 g's to give you for the wheels, but unfortunately I don't. The best I can do is use it as a lesson for the future and help you in anyway that I can in dealing with the insurance company. We already discussed that. I think that our customer support is the best it can be. I mean we got your car running in 2 days when the other shops couldn't do it in months. We even bumped it to the front of the line because we felt bad for your situation. None of that had anything to do with your wheels getting stolen (obviously this before the occurance)...that's just how we do.

It's kind of like a gas station or a grocery store. Just like the grocery store prices go up if people keep stealing the carts. There's a sign right on the carts that say this "in order to help us keep our prices low, please return the carts back to their proper place...blah blah blah"

I mean this sucks! Ya know? I'm sorry this happened...I'll say it over and over. It's not like I'm happy that this made it onto a public forum, although I knew it would. I just have to have faith that I'm doing the best I can with the situation given.
