All these things matter. Technically, if you are a minor in the presence of a "drinking" party, you don't need to be tested. Also, if the cop witnesses you drinking, you don't need to be tested. And finally, if there's a witness against you, you may also have some trouble getting out of it.
I would plead "nolo" and simply take what's mine for being guilty but also not open the can of worms for the officer to ream me. Law enforcement officials don't generally go to court without a slam dunk case. They don't want to be embarassed infront of a judge for lack of evidence. (this is golden advice here peeps, write this shit down!)
