View Full Version : Gwinnett Courts are a JOKE!

I always thought people were just pissed when they talked how horrible the Gwinnett Courts are until I experienced it first hand. Last year I was arrested for Possession of Marijuana (refer here (http://importatlanta.com/forums/showthread.php?t=225791)) and I finally got my day in court yesterday. Well they gave me two options:

1. If i try and fight the charges I would have a 50/50 chance of winning and it would stay in my record permanently even if I was found not guilty.

2. I admit to the charges, get 6 months of probation, 80 hours of community service, take some class, do drug tests every two weeks, and pay over $500 in fines and then i have a POSSIBILITY of getting the charges cleared off my name permanently.

Well being in the criminal justice program, I had to choose option 2 because I cant have any drug charges on my name if i wanna work in the field i wanna work in.

Note: I had a lawyer and my friend that got me arrested went to court with me also and told the DA he was responsible for the pot in the car and that I was only at the wrong place at the wrong time but nope, I was still as guilty as if they found 15 kilos of crack on me. Now I have to complete a whole bunch of shit while working, while attending school, and pay fines + probation fees that I have no idea how i'm gonna do.

Bash me all you want but FUCK Gwinnett, I hope their fucking courts burn down and all the stupid mother fuckers in there die a slow painful death :2up:

Y not no lo? Or pre-trial diversion? As long as it's just a misdomeanor it would be removed off ur record after a certain amount of time.

My friend got caught TRYING TO SELL marijuana and 2 types of pain pills. He was charged with 3 felonies at first. He went to court about a year later and they dropped the felonies. He now has 3 years probation ($130 a month to do drug tests once a month) and thats it. This was Gwinnett county too.

What I don't get is that... If you are NOT guilty after fighting the case, why would it stay on your record? Lol. I've never heard that type of shit before.

hmm..normally when your arrested (not just ticketed)for it they just set the bail around 700-ish and thats it....no court, no nothing.......did it cost anything for you to get out of jail on top of this? sounds like you got back talked and screwed......you should of had a right to a pre-trial sit down with the DA and never even see a judge. most people dont want to see a judge even if it means they pay more because your at the mercy of the judge and he can go max fine and penalty. sounds like they threw you thru the gutter on that one man. you never even know...your buddy may get off with less if he pleads not guilty.

as long as they get money they will work with u. They dont want u to prove urself "clean" and clear the record and act like you were innocent when u were innocent. UGH.. they HAVE to have some money to cooperate.

WOW you got screwed...you could and should have plead first offenders or no-low or at the very least not guilty and it would have came off of your record. how can they charge you with possession when your friend took the fall? that makes no sense

You should have fought it, no matter what you do if it is there ( on your record) it will show up even if it expunged. When applying for a criminal justice job they see every thing including expunged stuff, you might as well change your major and plan to do something else with your life. (this is the reason I am a Paramedic and not a cop) They do a different type of background check than the normal type, and you will never be allowed to posses a fire arm, I can because I used First offenders for a drug charge.

same thing happened to me a few years back, he charged me with possession, (I signed the citation) and fought it in court, after over a year, finally got my day in court, told them the story, judge was like, you seroius? you're free to go.

so unless they tested you for THC in your system at the time of the traffic stop, they don't have a case.

it was pretty funny, my buddies got charged, did their community service, classes, etc, got all that stuff done with by the time I got my day in court.

what are you planning on doing after you get your criminal justice degree? just wondering. i plan on going back to finish my criminal justice degree

I just looked back on your original story and you got scared into option 2. The weed wasnt on your body and it wasnt your vehicle so they had no case. You cannot be too far into the CRJ schooling either if you fell for this one. If your lawyer went along with this without firmly telling you that they had no case you need to look into a new lawyer and if its possible to file some type of motion for inadequate council.

I sure am glad I don't have to worry about anyone's judicial system. Seems to save a lot of unnecessary hassle. That and the added benefit that I don't have to look over my shoulder 24 hours a day is very nice when living my life. Later, QD.

What really sucks now that even if you didnt get a felon or you got 1st offender you will NEVER be allowed to get a GFL ( Georgia Firearms license)

NEVER...... Even if it is not on your recorded the arrest is and the NCIS<GBI etc will find out and you will not be allowed for the GFL.... that is bullshittt

I suggest you read the laws..Not trying to be a smartass.

But it doesnt matter if its on the person or in the persons car. They can charge you with it, if its close enough to you. Like say in reach.

Sorry the OP got charged with this, but if you hang out with folks that do that, or associate with people that do it, then you are putting yourself into trouble...The cop shouldnt have been a jackass either
