that sucks! My apt almost got broken into a week after I moved in it. My bro was home at the time and the guys knocked..my bro looked through the peep hole didn't recognize the 2 guys so didn't answer, but stood at the door to see what they were going to do. Well i have 2 dogs which they heard bark, and my brother heard one of the guys say "i'm not scared of no dog, if anything we will just run".
my bro had to leave for work not long after that, and he saw one of the guys standing in the parking lot near his car..as soon as my bro starts to pull off he sees the guy get something out of his car and walk down the breezeway towards the apt..my brother pulls a reverse back to look down the breezeway to see what the dude is doing..the guy looks back sees my brother and takes off running..yells for his buddy who was in the building next to us, get in the car and speeds off.
CRAZY!

They are tearing down the projects downtown so all the people are moving to the suburbs. I was planning on selling my house and moving towards carroll or paulding but then the housing market took a dump. Get a big dog. I have a shepherd and no one even walks on the same side of the road as my house.

Deadly Force
There are 3 code sections that govern when lethal or deadly force may lawfully be used.
Defense from a forcible felony; A person is justified in using force which may harm or kill only if he or she reasonably believes that such force is necessary to prevent death or great bodily injury to himself or herself or a third person or to prevent the commission of a forcible felony. You are not justified if you were the aggressor or you are/were/on-the-way-to committing a felony. (The state has pre-empted local cities and counties from further restricting this defense.)(16-3-21 (http://www.georgiapacking.org/GaCode/?title=16&chapter=3§ion=21))
Defense of habitation; (here habitation means dwelling, motor vehicle, or place of business) A person is justified in the use of force which is intended or likely to cause death or great bodily harm only if:
A person is breaking\has broken into your home in a violent and tumultuous manner, and you think that the intruder is going to assault you or someone else living there.
A person who is not a member of the family or household and who unlawfully and forcibly enters the residence and you know it is an unlawful entry.
The person using such force reasonably believes that the entry is made or attempted for the purpose of committing a felony therein and that such force is necessary to prevent the commission of the felony.
(16-3-23 (http://www.georgiapacking.org/GaCode/?title=16&chapter=3§ion=23))
Defense of property other than habitation; Lethal force cannot be used to protect personal property unless the person using such force reasonably believes that it is necessary to prevent the commission of a forcible felony.(16-3-24 (http://www.georgiapacking.org/GaCode/?title=16&chapter=3§ion=24))
(Stand Your Ground/Shoot First/License To Murder - went into effect July 1st, 2006) If you have determined you need to use lethal force (as stated in one of the underlined "Defense" sections immediatly above) you do not have to try to retreat before using that force. If your defense is valid, you are immune from criminal procecution (unless it is illegal to carry that weapon where you used it) and civil liability actions.(16-3-23.1 (http://www.georgiapacking.org/GaCode/?title=16&chapter=3§ion=23.1), 16-3-24.2 (http://www.georgiapacking.org/GaCode/?title=16&chapter=3§ion=24.2), 51-11-9 (http://www.georgiapacking.org/GaCode/?title=51&chapter=11§ion=9))

heh, I'll never forget when I was up in Ohio visiting my dad and we heard someone breaking into his townhome. My dad grabbed his handgun ( Glock 9mm ) and walked down to the top of the stairs as the guy was coming out and shot out his knee cap, the guy fell down the stairs, hit the bottom, my dad walked down to him, and proceeded to pistol whip him across teh head rendering him unconcious, then proceeded to call 911. The operator was a bit shocked lol.

You should have waited until he got into the house. After that because of Georgia's Castle Laws it is game on for anyone breaking into your home. They could be butt naked holding a Peace Sign and you can kill them. Not outside your home but in your home yes.
Now if you were living in Massachusetts you would have had to of first attempted to flee on foot. And if say you were finally trapped in your attic and he maybe fired a couple of shots off at you then you can fight back with deadly force. But no suprise coming from a state Ted Kennedy runs.

I can assure you that you never shoot a warning shot. You could honestly be charged with discharging a weapon inside of the city limits.
You could also hurt someone when the bullet comes back down as well (if you fire up). If you fire into the ground, the bullet might ricochet into something else.
You either shoot to stop the threat or you don't shoot at all.

My brother and father are, but anyone can look up the GA code and/or case law (like all lawyers do). I grew up around the law, so you pick up on it (like all lawyers do as when you graduate law school, you aren't really skilled in any specific area of law - you need to learn your specialty in the real world for the most part).
I make it a point to know concealed weapon/handgun laws in GA as I need to know my rights for what I can/can't do. I don't want to go to jail.

A "non" lethal shot? Center mass might be lethal, then again, it might not. However, if you do have to shoot someone, ALWAYS go for center mass as that is the largest target.

Very true. When guns do get fired it needs to be to kill. Becuase say you do shoot him in the leg. In that same time he could have been drawing a pistol and was going to aim for your heart. Yeah you got his leg. But now you are dead.
If you fire a gun at someone playtime is over.
And aiming for kneecaps that are moving. First off if you are firing a pistol at someone you are going to try to aim with an unstable platform(Your extended arms), have adreneline going making you even shakier and more unstable. Then you'll be squeezing a trigger causing your gun to move more. On top of trying to cordinate your eyes with yoru gun and a moving target of about 4"x4". You'd be lucky to get anywhere near the kneecaps.

Yea, he should have shot a man on a ladder in his back yard. Then he could have gone to jail and gotten sued.
If you shoot someone you had better damm well kill em. And you had better do it INSIDE your house. Do it outside and any cop in the land will tell you, you will get ****ed. If you just shoot em and don't kill em, our superstart justice system will allow them to take all your ****, the very same stuff you shot them to try and defend.
Sorry buddy, the "Wild West" way of thinking just don't cut it no more.

With the passing of the "stand your ground" law passed a couple of years ago, the "Wild West way of thinking" does cut it. But only in certain situations. This would NOT be that situation. Later, QD.

You are correct. I wasn't aware of that law. Interesting.

Yea, he should have shot a man on a ladder in his back yard. Then he could have gone to jail and gotten sued.

Yes and no. Georgia has a "Stand your ground" (both in public and private) law now to go along with the Castle Doctrine.
me and my mom just walked in ( about an hour ago ) and the dogs were goin crazy at the back door . so i told my mom to hand me her gun (380) and proceeded outback . some stupid mother****er was climbing up a ladder to MY window . i told him to ****ing freeze and he reached behind him so i popped off a warning round . well he jumped off the ladder( 10ft at the most ) and ran . so we called the police and now they are trying to find him. messed up thing is i live in a nice ****ing neigherborhood . ever since the buses run from atl to douglasville , we have had problems . im bout to say **** this and move farther out towards bama.

i would have shot his @ss while he was runnin.
You had better hope he was running towards you, because if he was running away and you shot him, then you'd be the one going to jail.

In many states you are required to flee a confrontation. And you can only use deadly force if you are basically trapped in a alley with 20ft walls on all three sides and the person after you has a gun that you can clearly see is a weapon and not a fake gun before you can return deadly fire via firearm, knife, Bow&Arrow(wouldn't that be funny. He'd be telling his friends he robbed Robin Hood and he shot his ass with an arrow.), etc.
From what a cop told me this is what "Stand your Ground" means. Now it doesn't mean if someone tells you to F-off and they are walking towards you that you can shoot them. But say you get at a confrontation at a Redlight. Guy gets out with a Baseball bat and comes towards you. You pull a gun and point it at him. If he stops then you can't shoot him. But if he continues you can shoot him dead right there.
Not sure how accurate that is but that is what a cop told me.

I wouldn't go on the word of any policeman when it comes to most unconventional laws. As odd as it sounds, these guys don't know the complete laws themselves. You'd be best to look up the codes yourself and talking with higher ups than your beat officers. Later, QD.

True. He admitted he wasn't too sure on it. I figured if a shooting did occure they'd arrest or atleast take the shooter into custody and let the lawyers and judges work it out.
Unfortunately many of these laws are too vague. And often times it's left up to lawyers, judges, and worste of all idiot jury members to figure crap out. I've read through some but I think I'd need to higher a lawyer just to explain it to me and even then lawyers aren't infallible.
I say a general rule wether you are right or wrong is do what it takes to survive. Even if you spend time in jail it's better than dead.
