so today like 11 i get a call from daycare for me to come pick my boy up,they said he might have a busted lip and may need stiches.
so i leave work and when i get there he is covered in blood.
i look in his mouth and his teeth are FUCKED i mean FUCKED i had tears in my eyes but he was so calm and took it like a man and he is only 3.
so i go to the er and they did nothing and to make a long story short the dentist had to remove 3 of his front teeth and possibly another if it gets infected and he has 2 metal clips on his lip he had part of the bone removed because it was shattered he went through hell and now i am broke (no insurance) man i hope the daycare is ready for me on tuesday.they are gonna pay or the kid at daycares dad.the little shit hit my kid from the side with a cart of some kind and he fell on a toy or the ground all i know is my son is in pain and i hate seeing him like this....he is 3 and is on a freakin liquid diet for the next 10 days and gets to be tooth less for the next 3-4 years..and his adult teeth may not come in correctly....dammit!@!!

im afraid im gonna have to try and do that.i hope im not wrong for doing so but i feel i have to.unless the asshole who was suppose to be watching him and the other kids dad would like a kick in the teeth from a big guy with a dr.martin on his left foot ;)

Scary stuff man, I hope it gets worked out. To look on the bright side, at least he's young with his baby teeth and a quick-to-heal body. I'm hoping for the best, though.

Negligence from the day care.... very serious crime, and im not being sarcastic
Bringing this law suit up would spark some major investigation issues
OR you could just flat out tell them, "Hey unless you pay for his med bills, i will be filling a law suit and an investigation"

i know they are baby teeth but from now until he is 7 all of his pics are gonna be toothless.not to mention how cruel kids can be teasing and all and the possiblity of a problem with his speech he starts pre-k this fall and he is very smart i even have him counting in spanish but what good is that with a lisp,it will only make him feel dumb.he is sleeping now with a massive fat lip and black gums and blood on his face he looks miserable even in his sleep.

the downside is his daycare has taught him so much they actually teach and have made him pretty smart,he suprises me everyday i would hate to loose that and he like them hes been going there since birth but.each time i pull up i see the same little kids playing to rough and the same kids are always on red on the charts because they are brats and one of them is resposible for my kids injury. i dont want to shut them down but i do want them to pay and at the same time i dont want my boy to be kicked out for being a victim...make sence we pay big for this daycare...

i feel for you buddy, my younger brother had a same sorta thing.
He walked out into the street while in the care of a day care service and was hit by a motorcycle, He is fine, but he needed some stitch's and a cast on his left arm.
Motorest was COMPLETELY apologetic, he was going the speed limit and honestly did not see him. The day care person had her boyfriend over.... and they were talking...
well needless to say it got down to the point of YES, it was a good place and he learned alot BUT my family spent WAY to much money to just have some joke of a lady watching the kids and to have them make a mistake this huge...
we sued for Negligence, Pain and suffering and there was one other thing too
basicly they paid for all the med bills and even a bit extra =)
yes we lost that contact as a day care, BUT we found another one, my brother is OK and we do not have to worry about this happening again
Who gives a shit about losing some day care, it is your sons safety that is the 100% MOST important factor here, who knows, next time he might lose his eye or something...

could you refer me in a pm to the the law office you used if you could...and im so glad my son was not hit by a bike or car.i have seen the same thing there they have good teachers and thats what we pay for but at play time no one really pay them much attention.

sorry to hear this. Unfortuately, somewhere in that contract you signed when enrolling your kid at the daycare, they probably covered their ass in situations like this.

As for the daycare, file a lawsuit. Do not worry about loosing a contract with the daycare, because your son's loss is more important. Also, do you know if the daycare attempted to help your child when he was hurt, or did they just called you directly?
