Anyway, my lease is up on the 15th(thank god after a year of BS)...


Back in november, my roommate/girlfriend moved out and broke her lease without my consent (cause we were till a third left on teh lease and she wouldnt pay shit) and went and got her name off the lease WITHOUT my signature..This is AFTER my property management group told me that both of us had to be present (in the office at the same time) to sign a notice to vacate.

Since June or july, i have not received a rent statement. This wasnt a huge issue until last march when we went to combined billing cause i used to just shell out $595 and call ita day and wait for my utilities..this is interesting cause the first day after my rent is late, they hit me with a $75 late fee and other junk fees making my base rent go from 595 to about $700.

since november i have requested a copy of my lease ATLEAST 15 times (over the phone to either have it faxed to my desk where i can reveiw it or printed where i can pick it up) and STILL have yet to see it. Im actualyl going to call again in a few minutes to request it be printed AGAIN so i can get it on the way home. When i payed my rent last month (my sister took my credit card to pay it since i was working and once again last minute cause no statement), they told my sister that i wasnt on the lease....then someone else told her i was a occupant and not a leasee...then the story changed to i was a leasee and the ONLY leasee. They refused to give my sister my rent amount but disclosed private info with her regarding other issues.

well anyway, my rent was due the 4th...i knew it was so since once again i did not receive a statment, i called and asked them what it was and asked for a credit card authorization form. They faxed me the form 4 hours later after i called 4 times to determine status...It took my sister calling there (she works for the same group just a different complex) before they faxed it...30 seconds later, it was faxed...hmm...

so i send them everything they needed for the authorization...this is on the 4th...today is the 12th...they call her today saying my payment didnt go through and now they are hitting me with junk fees again...heres the issue...Theres enough money in my account NOW by over $100 to cover it....between the 4th and today, theres been a surplus between $100 and 400 to cover the rent.

My question is can they charge me the late fee for payment after the 4th if i sent in the form?? i have bank statments printed, a code to call the bank back where they didnt even try to process it yet (as of two days ago on the 10thj), fax logs, cell phone records, etc. showing where ive called, sent payment and everything, can they charge me because of THEIR lack of processing?? They called my sister and actually told her my account was going to collections which is what pisses me off the most. They are going to send my shit to collections cause they fucked up?? no..

Thanks in advance and if any of you guys know a good lawyer, PM me a name and number cause i have a feeling this might end up needing one.

I own a triplex but we don't work the corporate way, I guess you could say. It's pretty laid back. We have lease agreements but everything is stated on the lease. I guess this is where your problem is coming in. Can you just go down there and wait for them to print it our instead of calling?

ive tried that 3 times and they are like "were busy" or "our servers are down" or some shit EVERYTIME so thats why ive called it in and requested it...Thats the biggest issue you are correct but the other issue is that when i let my sister pay with my CC, they said they couldnt run it cause "your brothers rent total is priveledged info" then tell her im on it then im not to im the only one. I just want to see it and if im not, fuck them, im dipping tonight:goodjob:

the other issue is that now they are tryign to charge me EXTRA shit cause they didnt run my CC approval form and are now trying to charge me almost 600(instead of my prorated 380 they shold have) plus $75 late fee so double what it should be for 15 days.

then again, it really doesnt surprise me.. i know about 10 people that have lived in teh same complex and have hated it and out of the 10, only 1 said they would ever consider leasing there again if they had to

did you sign a lease? If you signed something then you are probably "on the lease". If yu didn't sign anything then you are probably just listed as an occupant.

i signed a credit check but whenever we got rent until the combined system kicked in with utilities, the rent was in my girls name and didnt have me on it at all. i honestly dont remember signing anything other than the credit check but when we moved in, i was in a rush cause i had to go to work (shitty excuse) but they never gave me a copy of any of the paperwork at all so im not sure what i signed :(

Well a credit check isn't a lease. It doesn't bind you to anything. BUT why would you fill out a credit check if you weren't going to be on the lease.

Lesson #1: ALWAYS READ WHAT YOU SIGN AND GET A COPY OF IT! for real.

cause my credit was shitty at the time but they wanted to check it just to make sure but i think it was only under my girls name since we got in $0 deposit and the rent was only her name...can i be stuck with the shit just being an occupant if im not a leasee?

I'm not sure it all depends on what the lease says and if you signed it. I get the feeling that you didn't sign one or else they would have given it to you. Start keeping record of your interactions with them and keep track of the dates that you send stuff. And try to use venues that are easy to track. Like if yu fax something, keep it. Usually the fax will let you print out a report of when you faxed something.

yup mine does the last 40 faxes so i have when they sent me my CC paperwork to pay my rent with the fourth, the time i sent it back and have all my phone calls documented and my sister has her call documented as well...5 phones calls for me to try to pay my rent is rediculous

That sucks. I would just pay what I think I owe. Make them take you to court then the burden of proof is on them. From this point forward be very particular about documenting what goes on. Make sure when you call and get a response from anyone to write down the date and time of your call and THE PERSON YOU SPOKE WITH.

yay, finally out of the hellhole. reprinted fax logs and bank statements today and going to talk to a laswyer this week....they sent my account to collections for $489 cause they said my CC bounced but my bank says it was never even inquired on and they told my sister they didnt receive my credit card approval til the 7th when i have a confirmation on the 3rd...my rent was on time and they charged me a $75 late fee and now ive lost my security deposit cause of collections...they supposedly ran the CC payment the 7th for $489 but until the 12th i had over $600 in there.....hmmm

shit affects my credit, then i think ill be taking them to court
