NEED HELP...Serious Note Lawyer info needed

Ok so here is a little bit without getting into details much, but I need a lawyer that can handle a civil action suite against me and I need reasonable priced because I'm always always broke....

:ex went crazy and filed a restraining order.
:ex trying to get full custody and no visitation rights for me.
:ex trying to get child support.


I'm so close to tears because there is a chance that I may never see my daughter again. She is 3 years old and definitely my world. So if anyone has any litigation experience or a lawyer that is good and can help out with $$ side of it that would be greatly appreciated. I need to know ASAP

My court date is Monday morning in Gwinnett Superior Court.

Dont worry to much about not being able to see your daughter.. Unless you did something real bad, I highly doubt that will happen.

Custody, falls right under what I said above, but, more then likely, you will not get Full custody unless you have some proof your ex rides the yellow bus.. which is unlikely..


But sorry to say, you will pay child support.

Julio - preeshiate it. I am not worried at all about paying child support...I have reciepts of what I pay for my daughter and such so hopefully they can at least lower it.

Its not a divorce because she and I were never married. What she has done is file a restraining order saying that I verbally abuse her, beat her in front of my daughter (never ever have i layed a hand on a woman), history of substance abuse (i like to have a beer or two every so often....wtf), and somehow she has gotten expresses views and wants of homicide or suicide...i swear this is like a bad dream...

If there is no proof of you doing such things, then it's your word against hers. Hopefully justice prevails in your favor, that is if you truly are tellnig the truth. Couldn't you win custody and have her pay child support?

I have never abused her or my daughter....why would I do that. I'm not a piece of shit. There has never been a police report because like I said I've never hit her. As for the restraining order...I was served with it Monday night at 9:30 pm. It says that I have beat her, verbally abused her, and threatened to kill her boyfriend. (all in her hand writing as per law I have to have a copy).

- Verbal abuse....i guess that stems from her yelling at my daughter for no reason so i yell at her about that.
- hahahaha I told her that if she moves in with her new boyfriend that he better never lay a hand on my daughter or else I will come for him (parental instinct). Ohh and other than that I have a voicemail on my phone (dont know if it will be admisable(sp) in court), but it is pretty much her boyfriend saying he was going to "stomp my ass and put me in the ground." He cannot and never will be able to discipline MY daughter. Hell I don't even spank my daughter if she is bad. She knows better lol.

As for that yes I know...I was not given much of a chance to prepare either. Served with the order monday night and on the order it said i have court the following monday morning. My ex's uncle called me yesterday to warn me...he thinks what they are doing is wrong but is trying not to get in the middle so as not to start any inter-family(if this is a word) drama. He basically told me that they will say things such as I abused my ex in front of my daughter and that I have never paid for a single thing in her 3 year existance (bullshit I pay my daughters preschool monthly, as-well-as, clothing, food when she is with me (otherwise her mom, my ex, is on food stamps even though she lives in a $300k+ home in grayson), toys, etc.


Like I have said I do not know how to handle this. I stopped smoking weed in highschool when I found out that my now-ex was pregnant for fear of one day her using any habits i have against me. Now she is trying to use the fact that I like to have a beer or two with friends...rarely getting drunk. The only time I have gotten drunk are at parties with a designated driver.

I hate this situation and cannot wait for it to be over.

II hope justice does prevail...I have never been more scared and irate at the same time in my life. I don't care if she wins custody and child support I just do not want to lose my rights to my daughter. I want to at least have visitation or 50/50 custody....I want my daughter to be able to see her mother...I'm not as heartless as my ex.

I cant say that i feel your pain in this. but i do understand what your going threw. my sister is going threw the same right now. except her ex did beat the crap out of her and is still stalking her even with the restraining order. The bad side is she managed some how to pull a restraining order out of her ass. but the good is if it isnt proven or you can prove that she is misstreating your daughter in anyway then shes pretty much screwed. not to mention if shes pulling in food stamps and miss useing govt funds in anyway then she can be in deep crap. I know it sounds shitty but proveing her an unfit mother is definit key in alot of this. You can choose to have defax come into the picture to make sure that she is being taken care of and yes the voice mail is admissable in court. he left it on your voice mail knowing he was being recorded. and that being said shes putting your daughter in an unsafe environment which goes in your favor. I would bring up some of the bad things that shes done (but only if she does the same) keep it a level playing field, Id ask for a continuence to try to get your shit together. Your going into this blind and you dont know what tricks shes has up her sleeve. I wish you the best of luck my friend. and I hope that things truly work out for you..
