    Would you pled Guilt or not guilt to under age drinking? When the officer never test you for drinking?

    what are the factors of the case? How would he prove you were drinking? where there others there? What is the exact charge?

    All these things matter. Technically, if you are a minor in the presence of a "drinking" party, you don't need to be tested. Also, if the cop witnesses you drinking, you don't need to be tested. And finally, if there's a witness against you, you may also have some trouble getting out of it.

    I would plead "nolo" and simply take what's mine for being guilty but also not open the can of worms for the officer to ream me. Law enforcement officials don't generally go to court without a slam dunk case. They don't want to be embarassed infront of a judge for lack of evidence. (this is golden advice here peeps, write this shit down!)

    the charge is beer & wine. Thats about it. He just took me out of the passager side and just hand cuff me and went straight to the car. When got to the station. Just took the pic and place in a holding cell. So basically no proof i was drinking. But my driver was tested positive.

    Did he ever ask if you would take a test. If you say NO to an alcohol test your automaticaly Guilty.
