    Default Fight @ Work?

    ok so here's the situation. 2 guys we'll call them Bob & Jim and they valet cars. well, Bob is new and Jim has worked there for about 2 yrs. Bob is informed by the boss that @ the end of the night tips should be split evenly and whoever leaves early should get 1 $ for every car left and the person staying keeps the rest. But Jim tells Bob something completely different. he gets into a equation of dividing hours @ $10per/hr or something. Tonight Jim tells Bob to leave early and they'll do the math for the tips(note:Jim's way of doing it lets him keep More than his share should be). Bob dosen't want to leave early b/c he thinks Jim is trying to screw him. so Jim calls the boss...ok, long story short(little late for that) Bob will stay and the tips will be divided the way the boss says they should be.
    the time comes to count the tips. Bob has(to make it easy) $50. Jim accuses Bob of lying saying, "you parked more cars and I have more than you?!" Bob asks if Jim is accusing him of lying. Jim gets in Bob's face and throws the first punch . Bob retaliates and Jim runs away.

    funny thing, during the altercation Jim said ok ok, chill out and Bob let him go. the Jim took another shot. this 1 connected but had similar results to his 1st shot. Bob just smiled and landed a few b4 Jim ran away saying, "I'm calling our boss!"

    I just talked to my boss and he basically didn't say anything. sounded like he didn't believe me. I did tell him that IA has voted 8-4 in favor of me staying and all 12 think "Jim"(not his real name) should be fired.

    Jim should be facing some sort of action up to the employer's discretion. You on the other hand should be fine. However, you know how some employers are with seniority and shiat. Believe that the existing employee is always telling the truth and etc.

    I deal with HR at least weekly.
    1. Jim threw the first punch= immediate termination. And in the court of law, he is guilty. NEVER throw the first punch. Now Bob can use the self-defense arguement. FIghting on the job is a NO NO.
    2. Bob= write up, maybe even a final write-up for lying on what the boss said and misappropriation of company funds. Now this also can be termination but since he has 2 years and never was caught before, I'd give him a final warning with the understanding it happens again= termination
