based upon defendant vick's subsequent admissions to plaintiff elliott after april 13, 2003, defendant vick had knowledge at the time of his bare genital contact with plaintiff elliott on april 13, 2003 that he was, in fact, a carrier of genital herpes. despite that knowledge, defendant vick did not inform plaintiff elliott of his condition on april 13, 2003 or at any point prior to that time so that she could make a knowing, informed and truly consensual decision to not engage in any sexual encounter with defendant vick.

it goes on to describe pretty classic appearance of herpes, as well as her treatment.

i would imagine the chick's been trying to get him to do something over the past year, and he's chosen not to. sometimes you have to bring a lawsuit to let someone know you're serious.

hopefully his camp gets it right and pays what they owe... which assumes she's telling the truth.

i'd think that it would have been cheaper to pay her in the beginning, then to let something like this come out, as it may very well affect future endorsement deals.

if the person knows they have a sexually transmitted disease prior to sexual contact, and does not inform the partner prior to any sexual act, then yes, that person could be sued. the unknowing partner must prove that:

1. the person had a sexually transmitted disease prior to sexual contact
2. the person knew he/she had the sexually transmitted disease prior to sexual contact
3. the person made no attempt to inform or warn the unknowing partner prior to sexual contact.
4. the person made no attempt to use precautions prior to or during sexual contact.

the unknowing partner can then sue for negligence, assault and battery, and medical bills that result from contracting said disease. the unknowing person may also be able to sue for physical and mental pain/distress, depending on the condition.
