Man Says Airline Grounded Him For His Girth Reporting

CBS 2's Mike Puccinelli reports that their trip out West went South when a man claimed he was picked on because of his size.

The man flew from Midway Airport to Las Vegas without incident. But when he tried to fly home to Midway several days later, he says he was prevented from doing so because of his girth.

Emery Orto has a canceled ticket from Southwest Airlines, which says, "OK to refund, did not travel." What it doesn't say is why the Park Forest man didn't fly last week.

"They gave us the impression I was too big or too fat to fly," Orto said.

For that reason, this 6-foot, 350-pound man says he was barred from flying home with his wife. Orto says he was 20 feet from getting on the plane when he was stopped.

"She hustled after me and grabbed me and she said 'Can you sit in an airplane seat with the arms down?' I told her yes, I could sit in the seat with the arms down, I've flown many times and never had a problem. And she said, 'Well, you're not flying today.'"

Clara Orto is still enraged about what happened to her husband of 43 years.

"I just can't believe how heartless they are," she said. "They had no reason to pick on him."

Orto says Southwest's decision cost them more than $800 and turned what should have been a four-hour trip home into a more than 19-hour odyssey.

"I would love a written apology, and I would love the money we were put out and something for our pain and suffering," Clara Orto said.

Emery Orto says what's most bothersome to him is that Southwest never tested whether he could actually fit in a seat with the arms down.

"That is absolutely my problem. They didn't test me in any way," he said.

Orto further wonders why Southwest allowed him to fly to Vegas only to prevent him from flying home.

"It was just absolutely humiliating and embarrassing," he said. "I hope that it never happens to anyone again."

Southwest says its policy has been in place for years and that Orto was arguing with an elevated voice in a belligerent tone. The airline also says that at least four passengers said they weren't comfortable flying after watching Orto lose his temper.

Southwest says in the end it was the anger issue that ultimately eclipsed the weight issue that led to Orto being barred from the plane.

So why was he allowed to fly to Vegas in the first place? Southwest says the Chicago crew simply made a mistake.
You would think being 6 feet tall and 350 lbs would be humiliating enough in itself!

    Here's the porky puke himself.

Yeah it is. 6 feet tall and 350 pounds (probably a low estimate) equates to a BMI of 47.5, which is considered morbidly obese.

That's like a typical football player size. I definitely think they should've at least "tested" before telling him no.

FOOTBALL PLAYERS ARE IN SHAPE. This guy was clearly morbidly obese and had no such substance of muscle. clearly the personnel who stopped him could not tell if he was walking or rolling toward the gate.

Let's coddle people for being overweight.
    Sike.

It's just a matter of time before it becomes federal law that you can't "discriminate" on people who are obese...

well honestly come on.. would you wanna sit next to that guy? air planes get hot enough sometimes.. let alone haveing to sit next to a guy thats sweating alot. i think what alot of airlines are doing now days is if your that size. they charge you for 2 seats so you have that section to yourself. but they shouldnt have kicked him off the plane completely. unless he was being loud and unruley

I have no sympathy for fat asses. Stop eating so much & live a more active life. follow in this guys footsteps.

In the last 10 months I have completely changed by life and will be running the Boston Marathon this coming Monday.
For my whole story, go to www.RunningForMyExistence.com or just watch this video that I put together. BTW, I have never really edited video before but I'm proud of it.

    Date: June 7th
    Weight: 276.7 pounds
Distance I could run nonstop: 10 yards (seriously, that was it).
    Pants waist size: 46 inches
    T-Shirt Size: XXXL
    Age: 47

I began a training routine that included walking/running 6 days a week, spin (bike) class 3 days a week, and swimming 2 days a week. I changed my calories consumed to 2000 (previously ~3500-4000) and broke everything down into Carbs (40%), Proteins(40%) and Fats (20%). I focused on my goal of running the Boston Marathon, a dream I have had since my father ran it in 1968 when I was 7 years old. To keep me further motivated I concentrated on raising money for my 9 year old niece Julia who has Cystic Fibrosis and the possibility that the money that I will be raising will help find a cure for disease before she dies and very early death.

    Date: April 7th
    Weight: 163.6 pounds
Distance I could run nonstop: 21 miles
    Pants waist size: 32 inches
    T-Shirt Size: M
    Age: 47

I have been heavy my ENTIRE life and weighed over 300 pounds a little over a year ago (Jan 2008). I have never exercised more than 10 minutes and have NEVER run or walked as a form of exercise because frankly I hated walking and running.

It is my hope that other people will see this and realize that they can change their life and attain their goals if they just put their mind to it. People ask me if I feel better because I have lost all of this weight and I answer "Yes I do, both physically AND mentally". Life is good.
