1) clubs hire off-duty cops bc they shoulf KNOW the law. Knowing the law means that...
--> they should know that beating a handcuffed customer in the face while he's choking on a dumpster shouldn't happen
--> that they are job is to remove them from the premises ... not interrogate or torture them out back
--> the club should hold regular meetings on what is allowed and what is not for their security staff
** on a 2nd note, unless you are going to jail or having sex I think it's illegal for a bouncer to handcuff you - but I will check on that.

Wow you are stupid. Where did the clubs credability go? He has to first prove what they did outback. From the way he told it, there was just him, the bouncer and a cop out back. If there where no cameras its a cop's word against his. His being the one who obtained alcohol illegally. Next he has to prove that a bouncer sold him the bands in a bathroom, where %99.9 chance theres zero cameras. Next the club will have evidence of him buying drinks from the bar with a wristband, that hurts his credability! Bouncer gets in trouble for battery because they cannot beat up people by law, then the club owner is liable. Double win. DO IT!
A few points I would like to make.
1.Lose your license until your 21 because an alcohol related incident on your record says you will. Lawyer may get around this but its hit and miss.
2. Sue if you want, no one forced you to drink. The bouncer selling the illegal bands actually relieves the club of responsibility. He was not acting in accordance with his duties, therefore, not under the purview of the club. They MIGHT settle for enough to pay a decent lawyer though just to keep their name out of the papers.
3. It is not unlawful imprisonment if their duties include detaining suspects until police arrive, which is what most clubs do with underage drinkers. They do this to avoid the drunk driving incident that was brought up.
4. It is complete BS that a business could be sued because of the incompetence of the people that go there. Should I be able to sue my employer if I get hurt in a wreck on the way home? How about Kroger if I am on my way from grocery shopping? Your safety is your own responsibility. It is not the job of a business to babysit its customers.

Comparing a walmart employee to a bouncer at a club is a huge difference. There are a lot of diff scenario's that could play out here.
Opera could never want this to go to court, they wouldn't want their name in the paper saying that one of their bouncers got caught contributing to minors and for assault against the same minor.
Opera could say take it to court, say that the kid was, while intoxicated, being disruptive and causing a problem. After being handcuffed he was struggling and KICKING at the cops, and that was the cause for your eye, was defense. It may not swing but I know in KY that if you kick at a cop and he slams your head into a hood, good luck pressing any charges. Its them vs an underage drinking.
He could take them to court, they try the above, and fail, and he gets money, fined for underage drinking, the bouncer gets fired in all scenarios, and he gets money.

Kinda reminds me of when I was in college.. we'd get some kegs and leak it to the high-school kids (underage) on purpose. $10 to party. Then we'd get a good count at the door while keeping a GOOD lock on the booze. We'd call the cops on our own party -- as soon as the cops get there the underage kids would BOLT! And we'd say we called the cops to get rid of them b/c they were not invited.
We kept the booze AND the money from the door from those fuckers (it was NOTHING to get 100 high school kids or more to pay every month) - LOL. Next month, we'd do the same thing - LOL.

As far as I know....the cops never took his BAC, correct? So therefor, OP can claim that he never took a sip of alcohol. He had just bought the alcohol and was just chillin when the girl took a sip.
