    Default Gun question....

    1. A sawed off shotgunmeans a shotgun or any weapon made from a shotgun whether by alteration, modification, or otherwise having one or more barrels (including the chamber) less than 18 inches in length or if such weapon as modified has an overall length of less than 26 inches.
    2. A sawed off rifle means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder; and designed or redesigned, made or remade, to use the energy of the explosive in a fixed metallic cartridge to fire only a single projectile through a rifle bore for each single pull of the trigger; and which has a barrel or barrels (including the chamber) of less than 16 inches in length or has an overall length of less than 26 inches.
    3. A machine gun means any weapon which shoots or is designed to shoot, automatically, more than six shots, without manual reloading, by a single function of the trigger.
    4. A dangerous weapon means any weapon commonly known as a 'rocket launcher,' 'bazooka,' or 'recoilless rifle' which fires explosive or nonexplosive rockets designed to injure or kill personnel or destroy heavy armor, or similar weapon used for such purpose. The term shall also mean a weapon commonly known as a 'mortar' which fires high explosive from a metallic cylinder and which is commonly used by the armed forces as an antipersonnel weapon or similar weapon used for such purpose. The term shall also mean a weapon commonly known as a 'hand grenade' or other similar weapon which is designed to explode and injure personnel or similar weapon used for such purpose.
    5. A silencer means any device for silencing or diminishing the report of any portable weapon such as a rifle, carbine, pistol, revolver, machine gun, shotgun, fowling piece, or other device from which a shot, bullet, or projectile may be discharged by an explosive.
    1. look at number 3
so... with that said, does that mean you can own a burst fired weapon legally without a Class III? Since it's technically not a machine gun.

Class III weapons in GA are not illegal (full auto, burst, silencers, etc) as long as you have the proper paperwork (form 4 I think) to carry own them and paid the $200 tax stamp.

i know they aren't illegal, but its a biznitch getting a class III permit..

you need a signature from a cop, try doing that while being brown = impossible... takes forever... over 6 months

any sort of class III "machine gun".. costs $$$$$ For example, a FA AK47, goes for 15k-20k... they're 80 bux in pakistan LOL... the f'in gov't is taxin like a mofo on these. so they are techincally holding up the 2nd amendment by making it so easy to do it illegally- taking away your privelage if you get caught, and so hard to do it legally. Surely you wouldn't want a buncha criminals out there with 'em... But if they're criminals, do you really think they give a f*ck if its illegal or not

but yeah so with that said... a non-machine gun can be owned without a class III stamp... and a machine gun is defined as something that fires 6 consecutive shots in 1 trigger pull... burst auto, 2 or 3 rounds wouldn't be constituted as a machine gun, right? (based on what i'm reading)

Thanks for the response ruiner... waiting for the other gun-buffs to chime in... jamiecbr, et al.

also, whats the threshold for "modifying" weapons.... I know you need a special FFL to manufacture weapons... but a gunsmith does not. Any joe can modify their own stuff, ie upgraded trigger sets- reduced pulls, modify the entire setup even--- Ie .223 ar15's converted to shoot cheap .22lr rounds... Lol i'm just doin research... more out of boredom

You don't need a "Class III" Permit to own a gun. You just fill out the paperwork. There isn't really a "permit" per say.... It isn't that hard, really. You just need to set up a "trust". You need a license to be a dealer, maker, buyer, etc.

To purchase a BATFE tax stamp for a Class III weapon that is already in the registry; it involves the signature of the local Sheriff unless you set up a living trust. Some states do not allow ownership of Class III weapons; including NY.

Georgia allows for the living trust I do believe.

With that also said, the government charges a $200 tax. The "PRICE" that you pay is becuase of supply vs demand on the PRIVATE market. It has NOTHING to do with the government.

I see a lot of stuff wrong with what you said and/or what you inferred...

"If you use a LLC or Trust you dont need the CLEO signoff therefore you are and agent of the trust or llc and may use the NFA item because it is owned by either. It is a neat loophole that will be closed sooner than later. But upon dissloving the corp or trust you must transfer it in your name or sell it therefore puting yourself back at square one."

That sums up the CLEO signoff/trust discussion.

i dunno? I beg to differ on that.

The reason the supply is so low is because, those weapons are grandfathered in and there are only so many of them. The gov't i controlling the supply. I think there was a ban in like 86 for something, don't recall what. And I'm sure there is some sort of crazy limitation or stop to importation of machine guns from other countries. You'd figure anyone with any sort of entrepreneurial vision would definitely capitalize on this.
I don't know all of the details on this, maybe something liek the RBmotoring scandal is going on in this industry? who knows... but yeah they're RAPING.

Prime example, as i said above... why does a used fully auto pre ban ak47 go for 20k here, when a brand new straight from the crate full auto ak47 go for about 80-90 usd in Pakistan.

I'm sure there's more politics and stuff involved, but yeah the gov def has a large thing to do with why they're so expensive, making us law-abiding citizens pay the boot... When criminals and illegals(not saying that you do, but you CAN)are going to do whatever they want

With what you've said, a legal class III wep isn't as unattainable as I thought... I was talking to someone whom I thought knew a lot, but I guess not. He was saying how its a process that's not really worth it at the end of the day unless you REALLY need a machine gun. Like a minimum of a 6 month wait and your application gets conveniently "lost" if it isn't squeeky perfect or you don't have a lot of contacts/connections to ease the process.

with that said, i'm going to look for a nice little krinkov... and do some more research of course.

With certain exceptions a firearm may be made by a non-licensee provided it is not for sale and the maker is not prohibited from possessing firearms. However, a person is prohibited from assembling a non-sporting semi-automatic rifle or non-sporting shotgun from imported parts. In addition, the making of an NFA firearm requires a tax payment and approval by ATF. An application to make a machine gun will not be approved unless documentation is submitted showing that the firearm is being made for a Federal or State agency.

It doesn't really beat the system. You can do the same thing with plenty of other similar rifles. I've even heard of one guy converting one of the sporting-rifle replica AR-15/M-16 weapons with a real Milspec M16's damaged (and subsequently repaired) firing mechanisms.

Personally, this kind of gun law is...well. I'm just glad we don't have an outright possession ban like some other countries. Europeans like to pretend they don't have gun violence...

Go to the "Firing Lane" in Athens and work the "full auto experience" out of your system. It's fun at first, but after a while, it gets boring. Semi auto is the way to go (trust me).
