    Default Divorce Question?

    I herd that you can put an article in the paper and if the spouce doesn't respond with in so many days yo uare divorced. I don't see how that could be true. Does anybody know anything about this?

    yes that is correct if you are not able to get in touch with the other person... an article will be placed in the paper and they have 30 days to respond to it... if they dont respond, you are granted your divorce... I know this because when Brett divorced his exwife this is how he did it because he didnt know where she was at the time ...

    What if you know where the person is and you have tryed and tryed to contact them but they wont contact you back? Also How do you go about doing that do you just place the add or do you have to go to the court house first, and what does the add have to say, sorry so many questions.

    You file for divorce and let the sheriff take care of serving the person. They will get ahold of the guy. Once he is served, that's all she wrote.

    Here is a quote from HERE:

    If the filing spouse has made a 'good faith effort' to locate the missing spouse, and can swear under oath and penalty of perjury that they do not know the current whereabouts of the respondent and have made an effort to locate them, the missing respondent can be 'served' by publication of a notice in a local newspaper.

    In some counties, if you start at your mailbox, walk around your house, backwards, 3 times and recite the alphabet backwards, you should end up at your mailbox and open it and the final decree will be in there. I don't understand how it works, but that's what I understand. Later, QD.

    It's not that expensive to do an uncontested divorce even using a lawyer. I've seen ads for $399.

    Personally, I wouldn't use a lawyer in your case. If yall don't have a ton of property or kids to divide up, no lawyer is really needed. If I'm not mistaken you pay the $25 sherriff fee and the $25 or so filing fee, and you're off to the races.

    You can also contact the county for them to refer you over to legal aid. I believe it's free too. Although that may take you longer to do it, but I think it's free.

    To be honest, I'd borrow the little bit of money I needed (if you don't have it) and I'd go ahead and file the paperwork myself and be done with it. Let the sherriff's dept serve him at work or home, and then a court date will soon follow. You have your day in court, and voila! 30 days later you're done forever.

    In the county I have to file it in is $85. I can't use legal aid, I tryed that they only help you if you were abused or something else which he was abusive but when I called the lady I spoke with asked when the last insodent was, I was like umm I don't remember then she said if it was more than 30 days ago they can't help me. Anyways thanks everybody for the info it kinda helped I am still confused as hell. When it comes to this legal shit I am clueless as hell, I might just get a loan or something and hier a lawyer probably be my best bet, since I am stupid when it comes to all this LOL.

    You may be right.

    I've never been divorced myself. I was a pen stroke away from it years ago, but that's as close to divorce as I wanna get right now.

    That's just what I'd heard before. Even so, 90 days vs 5 yrs should be a walk in the park for her.

    In my case they I didnt know where she was and didnt care to know, so I had to have my lawyer post it in the paper, then you have to wait like 6 months before you can offcially be divorced, so the other person has time to contest. Thats how mine was because I didnt contact her, I just filed and waited my 6 months till it was able to be final
