His speech is protected even to the point of offending others. I think where it crosses the line is if he tries to provoke others, or if he implies a threat or intimidation.
I think the precedent here is cross burning. There was a case in Virginia that said the Klan can burn all the crosses they want on their own property, but if they burn one on someone else's property it implies intimidation and is no longer protected speech.
Jones is hem-hawing about whether or not he's gonna go through with it. He's claiming to have agreed with the Park 51 people that he won't do it if they move their community center. They are saying no such agreement has been discussed. At this point the damage is mostly done. If he doesn't have a Quran burning someone else will.
Jone's "church" is pretty much just a cult. There are 50 people in his "congregation" and contact with family members and the outside world is discouraged. They work for his business without compensation.

Jones even sets a weight requirement for his parishioners and weighs them regularly to make sure they aren't eating outside the church.
