If he did that, he broke the law. Don't just fight it, go after his raise. Make a formal complaint against him. Marks like that against his record will affect promotions, and thus, his pay.

Officer was heading towards him. No way he could get the tag (GA does not have a front license plate). Then the officer loses sight of the car (around the turn).
officer turns around and comes back and sees a car that fits the description. If he writes a ticket, he is accusing that particular driver of breaking the law - without any proof. That is a false accusation, since it is unproveable by the officer that this guy was the driver (remember, he was already out of the car).
What the officer should have done is given him a verbal warning. That usually is sufficient to get a person's attention (works on me). What the officer is betting on is that you will just pay the ticket and won't fight it (like most people).
GSP is usually a much more respectable group of cops. Stuff like this is usually pulled at the county level.

Odd, he was able to identify him as the driver when he found him inside the store...

Everyone is saying "fight it" and they are bitching about the cop. Guess what? He just admitted that he was speeding! Could he have been doing 70 instead of 60? Probably. The cop did nothing wrong. He is a witness to who was driving the car, obviously, by picking him out of people in the store.
With that said, what's to say that "soul" didn't see the cop following him into the station? Perhaps the cop lagged back, ran the tag, checked for warrants, and THEN got out of his car to follow him in?
You people assume too much and quote law as being exact when you are clearly wrong.

well i personally know soul if he said the cop came mins later after he was parked and in the gas station then he was parked in the gas station... i'm not normally one to jump on the band wagon of COPS SUCK but sometimes they make some dumb decisions. i would probably fight it in court but i would have to weigh whats more cost effective ticket or loss work/time in court

Not really. If the cop can identify him, he is toast. Also, the guy would also have to prove that he wasn't driving, either. :)

Minutes later is a rather large area of time...
Think about it: it doesn't take a cop minutes to turn around and follow someone. Chances are, he made a quick turn, followed him, ran the tags, and just waited til he stopped before he approached him.

that would be normal procedure... but i've had the same thing happen by suwanne cop.... i pull off of peachtree industrial blvd to l'ville/suwanne rd and i noticed to cops enjoying coffee outside their cruisers at the BP (its probably 10pm at night during the week)... i'm driving few miles later out of no where cop pulls me over right before i enter into l'ville... now he wasn't tailing me at all he came flying up on my tail in the dark w/o flashling lights or sirens he had to be going 80+mph then comes to crawl behind me turns on lights. then trys to give me a ticket for squeeling my tires when i made a left turn 5mins/miles ago; when he wasn't even at the intersection he was more then 100 yards away sipping coffee outside his car talking to another officer. :goodjob:

no he didn't give me a ticket and if he did i would of fought it and won anyway. there is no way something like that will hold up. how was he going to ticket me for something he can't pin point on me? there were atleast 10-20 cars on peatchree ind at the same time... he wasn't even watching traffic. if you know the intersection you would know what i mean alittle better. he was more then a football field away from me sipping coffee shooting the shit w/ another officer outside their cars.
he saw my car pass which was quite flashy so he thought he would get me for something. i should of turned him in for how he was driving. actually he pull up on me w/o any lights on driving in the dark w/o lights then he threw up flashers ;)

It was a busy road, N jefferson in milledgevill, kinda like 441, it took him a couple of minutes to turn around, he almost past the gas station, he had to make a quick turn into the second entrance from what i was told, he didnt even see my car at first.....

Good luck I guess, but remember that GSP has A LOT more freedom with the rules that they have to follow.
For example: City and county vehicles cannot use radar to give you a ticket for anything less than 10mph over (unless in a construction or school) zone. GSP, however, can give you a ticket with radar for 1mph over.
GSP can hide their vehicles and check for speed while city/county cannot.
etc, etc, etc

yep, but actually its 11mph...and it also includes campus police such as GSU, GA TECH, KSU, UGA etc...they also cannot clock you on a slope w/ a grade more than (11%?) unless its GSP of course.
i did a research paper on speed limits back in high school...

Correct, I should have said "more than 10mph". That's my fault. I had to research the law many years ago for a ticket as well.

Why would you fight it? You know you were speeding and the cop gave you the ticket for doing so. Now suck it up and pay the fine. I hope you learned your lesson.
If you were honestly going 60 and he wrote you for 70, it's the only thing that you should fight for.
