Over the last 15 months i have worked at my current job, I have EARNED 10 vacation days. i turned in my two weeks yesterday with the intent of working it out so i dont burn any bridges. i was speaking with my supervisor yesterday and told him i HAD to have the 20th and 21st off for training. He said that might not be feasible so i told him i would see then about the situation but if i was scheduled, i would not show up
Heres my question: Do they HAVE to pay me my earned vacation?? ive heard that they have to pretty much buy it out but if im quitting, somebody told me its their option and if i walk out, i get nothing. My thinking is that, any way you slice it, i stayed at a shitty job for too long so i EARNED IT and even if i say kiss my ass im out, i should still be compensated especially when 2 months ago, i requested vacation for this week (ironically) and it got turned down.
Any info is appreciated

well i dont think its their responsibility to give it to you. I believe its your responsibility to use it.
At my last job i used the week of vacation time i had as part of my two weeks i guess you could say. then came in and turned in my one week notice because i knew i was going to get another week off paid b/c of conflict of interest pay (moving from one bank to a competing bank). they walked me up to personell (HR) and i signed the papers.
I think they owe you vacation, but not sick time. But it may be the other way around... If you can't talk to your HR, find your new hire stuff, and check the manual.

It's all up to the company policy. Take a look at your company handbook and it should clearly define what happens with unused vacation. There is no law on this, they can choose to pay it or not pay it as a company policy.
The best thing to do is schedule vacations and have them approved before you turn in your notice if you are not going to be paid for the unused days.
(I'm an accountant but being the "head of the office" so to speak and the person responsible for paying everyone, I am pretty familiar with labor laws)

thats part of my issue....2 months ago,(july 3rd) i requested 3 days for this upcoming weekend to go to nopi. I was told THEN that it was store policy i couldnt get a 3 day weekend. So i go throught the handbook and long story short, end up asking the store manager. He said no it isnt store policy so the next day i turn in my vacation for the 11th-18th off then get told its blacked out through september throughout the store(6 people are on vacation this week...). Ive got training next week for my job at whichpoint i have turned in vacation requests for that still hasnt been granted. I just at this point, dont want to walk out on them cause ive got ~$400 vacation pay coming to me

Im thinking if i let HR know that i TRIED to take it but it keeps getting denied, i think they should still give it to me
you get paid vacation time and for annual leave. I rec'd almost $4K from my last job when I left. I used up all of my sick time with the birth of my son and didn't touch any annual or sick leave for the entire 14 months I was with them.

hell yeah, cool. thats what i was thinking. I dont care if i get paid for the sick pay, just want my vacation pay cause its about a week and a half worth of pay

All company policy is different. Some company will pay your OWED vacation if you resign, as others say fuck outta here.

Being affiliated with a Company's payroll doesn't associate that much with Labor Laws.
(I know a thing or two about labor laws myself, before ya ask http://forums.importatlanta.com/images/smilies/smile.gif )

hmmm, well the update is, im supposedly still getting paid for my vacation (so my old HR manager said) but not til corporate gets my termination paperwork...how long does that shit normally take??
