Basically I was backing out of a parking spot, and me and a truck collieded. But I am not sure who is at fault here. i think its a hard call

There are a few pics of my car, then some of the tire marks left my the gentlemen's truck, and I measured the marks they turned out to be 12 ft 10 in long.

the damage to my car bumper was torn in half, and messed up the back right tail light, and a dent in the fender (I guess from him hitting the bumper, some how crinkled it) also the side curtain air bags deployed, and the airbag in my passenger seat. I had a coworker as my passenger, and I took her to the hospital yesterday she has a strained neck, and back, and her hand is swollen very swollen. The Dr. said something about temporary nerve damage, so hopefully she is ok. I have a sore neck, and my back is hurting and aminor headache. But here are the pics...

How hard did he hit you? Sounds like a "Too Fast for Conditions" ticket for him. Hope you and your co-worker feel better.

Nitro I saw you in Winder yesterday...they put me in a rental car its a buick lacross :)(black)

But I will update the post later and post pics up.

In the state of GA, no police report is required if its in Private property. + No ticket neither.

Now, if you ask the cop to make one, He can do it for you.

So is a 50 / 50 shot really.

I always get a report, I dont care what though.

yeah but when it comes to filing for insurance most companies are going to want to see a report...

How fast where both cars going to have your airbags deploy...airbags are usually a higher speed thing then i would expect from a parking lot collision. Either way sorry to hear about the accident and i hope everything turns out okay.

Yes, its truea Georgia officer can not issue a citation on private property for a accident. But it is ALWAYS a good idea to get a accident report. The report can/will say which vehicle is at fault and you can use this for leverage with the insurance companies.

Case in point -

A good friend of mine was driving throguh the parking lot at the Mall of Ga. He was driving at the end of the parking lot where it is ok to drive. He came upon an entrance to the road the runs around the mall. Mind you there is a divider "island" of bushes between the parking lot of and access road. Well he comes to a stop, then proceeds. A van made a left turn into the parking lot and hit him. The impact changed my friends path from straight to 45* to the left. The van slid t othe right from the impact and collided with a Sentra.

Now, private property, right? Yes, no citations were given out. But, the officer did make a accident report in which he cited the drive of the van at fault. The van's insurance company didn't argue with the police report and paid rightfully.

You should have had a accident report.

Exactly. I've been in about 10 wrecks (yes really) and none my fault. I ALWAYS get a police report.

You hear horror stories of people not being able to get paid for damage, going to court, having to fix things themsleves, being without a car for days but that has never happened to me because I handle the accidents correctly. I have always had a rental, repiars paid in full, no arguements, no problems.

It's always, always best to get a police officer to write down the facts.


And I'm not trying to get on your case or anything, just in the future, remember this and protect yourself. Without a police report, the other person could easily just say "i wasn't even there" or "She pulled out in front of me withouth looking".

My first MINI was backed in to and rear ended. Read ended with 2800 miles on the odometer.

My Civic was totalled but before that it was hit in a Kmart parking lot, hit at my work parking lot, hit in a bank parking lot.

My 200 was hit in a lot in the bar district on Columbia, SC.

A few others.. rear ended here... hit while driving a friends car there..... it's fun, really.

Negative captain. Not required. At that point you have to let both insurance battle it out. So dont let your insurance feed you that BS if it ever happens.
Hopefully, if you are lucky and get hit by an honest and decent person, the thruth will be said before all researchis done.
