Regarding the "other thread" let me state my OPINION since i majored in law at ARIZONA STATE UNIVERSITY, one of the top business law school in the country.

NEITHER SIDE HAS ANY ARGUMENT. an heres why FOLKS:

1)Tracy received an email from a potential or current customer about another person spreading rumors or making an allegation about Batlground. This customer claimes that the person with the "blue high hp evo" claimes he knew that parts were stolen, cars had stolen parts, etc. Now, what we DONT KNOW was what EXACTLY was said, what CONTEXT it was said in, an how the conversation was brought about.

2) INNOCENT UNTIL PROVEN GUILTY, the person filing suit must PROVE BEYOND A REASONABLE DOUBT that their BUSINESS LOST MONEY DUE TO LIBEL OR SLANDER

3) BOth parties will LOSE at this game, just like the last year , its all bee nfor NOTHING. Batlground is still in business, isnt going anywhere, Speedmonkey an his crew are still here, ToPspE3D is still in business an isnt going anywhere. So all this bashing, bitching , complaining is for NOTHING because the situation is STILL THE SAME AS IT WAS A YEAR AGO.

4) We arent stupid, the "high hp evo" guy is charles. ok so lets touch on that. Freedom of speech, OPINION IS NOT SLANDER NOR IS IT LIBEL. If he or anyone has had a bad expierience an wished to express that, it is their right.

This is NOT SLANDER:
Charles remarking to another person:" my friend had parts stolen off his car while at Batlground. They steal parts an use them on their shop cars"

This IS SLANDER
Charles writing an article for the AJC:" my friend had parts stolen off his car while at Batlground. They steal parts an use them on their shop cars"

the difference is one is a HEARSAY CONVERSATION that only certain people were privy to. All charles has to say is "it was taken out of context, an yes, dans wheels were stolen from Batlground, thats what i said". or "no you have the wrong guy i never said that"

the other is a malicious attempt at DEGRADING OR ATTACKING SOMEONES CHARACTER. One has PROOF, one is HEARSAY. see the difference. in scenarion 1, EVERYONE loses, judge throws it out REGARDLESS OF HOW MANY WITNESSES OR ANYONE TESTIFY because its HEARSAY. Scenario 2 is easily proven, its a deliberate attack on someones business an or character with no supporting facts.

5) BOTTOM LINE is that this has all gone WAY TO FAR. I do not compete with Batlground, i do NOT CARE WHAT THEY ARE WORKING ON OR WHAT PEOPLE SAY ABOUT THEM. I know tracy, well before i worked for Mainstream. I have never seen ANY EVIDENCE that they steal or use other peoples car parts on their own car or anyone elses.

6) Dans wheels were stolen, so what. It sucks, its a SHITTY situation for both people. No one is at fault. Bitching about it is not going to bring his wheels back, an its not going to make batlground pay for them, so i dont see the point. its over, its done with, MOVE ON.

7) I have no problems with Charles , Speedmonkey, Dan, or anyone else, they have always been cool with me. An i have told them that the BEST WAY TO GET EVEN IS TO LET YOUR CARS DO THE TALKING. going on a crusade against a shop is going to prove nothing, becaue just like SOLOBOYs incident, no one has ANY PROOF. you think i give a shit what anyone says about me, or the shop, NO. Hondas may not be impressive, but my car would bust and has busted PLENTY of peoples asses, an it was something no one else had ever done locally. so talk all you want, i still got something you never had. it goes both ways for the parties in this fued.

8) Tracy has EVERY right to seek legal counsel or advice, shes not saying shes going to sue someone, shes saying that she wants to know their rights (if they have any) an if they could take any action, rightfully so. shed be stupid NOT to find out, its called running a business BOYS AN GIRLS, try it someday, protect yourself.

9) This whole thing is just one big ******** vs Batlground fued. that will NEVER be settled. my best advice is to LET IT GO. neither side will win, becuase neither side has a case, YET.

Tracy knows i have the utmost respect for her, an i actually refer people to batlgound often for cars we dont specialize in. I know she has referred people to us as well. we are 20 miles apart an coexist fine. I think you guys know that you have plenty of business, an the people that arent happy or "haters" will be haters, NOTHING you say will change their mind, fuck them, they aint bringing you money anyways, so whats the point. wash your hands.

Speedmonkey/Charles/Dan/Etc know that i have the utmost respect for them as well. If you guys arent happy with Batlground, or the service you recieved or your friends received, then my advice is DONT GO THERE, DONT SPEND MONEY THERE. your the consumer , the choice is YOURS. If someone ASKS you what you feel about their shop, i suggest you say "i PERSONALLY was not happy with their service". If you can say taht, if you have never been there, then i suggest you say "i have never been there, i prefer ******** for my car" an leave it at that. there is no need to spread rumors when you have no proof to back it up. end of story.


Please, both sides, do whatever it takes, be the bigger man, whatever, to let this go. because in 2 months it will be something else, then 2 months it will be something else.
