Is it fair? maybe not, but its the law.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 8 of Title 40 of the Official Code of Georgia Annotated, relating to equipment of motor vehicles generally, is amended by repealing Code Section 40-8-73.1, relating to material affixed to front windshields or front door windows which obstruct vision into vehicle, in its entirety and inserting in its place a new Code Section 40-8-73.1 to read as follows:
∀40-8-73.1.
(a) As used in this Code section, the term:
(1) 'Light reflectance' means the ratio of the amount of total light that is reflected outward by a product or material to the amount of total light falling on the product or material.
(2) 'Light transmission' means the ratio of the amount of total light, expressed in percentages, which is allowed to pass through a surface to the amount of light falling on the surface.
(3) 'Manufacturer' means a person who produces or assembles a vehicle glass-coating material or who fabricates, laminates, or tempers a safety-glazing material, which material reduces light transmission.
(4) 'Material' means any transparent product or substance which reduces light transmission.
(5) 'Multipurpose passenger vehicle' means a motor vehicle designed to carry ten persons or less which is constructed on a truck chassis or with special features for occasional off-road operation.
(b) Except as provided in this Code section, it shall be unlawful for any person to operate a motor vehicle in this state:
(1) Which has material and glazing applied or affixed to the front windshield, which material and glazing when so applied or affixed reduce light transmission through the windshield; or
(2) Which has material and glazing applied or affixed to the rear windshield or the side or door windows, which material and glazing when so applied or affixed reduce light transmission through the windshield or window to less than 32 percent, plus or minus 3 percent, or increase light reflectance to more than 20 percent.
(c) The provisions of subsection (b) of this Code section shall not apply to:
(1) Adjustable sun visors which are mounted forward of the side windows and are not attached to the glass;
(2) Signs, stickers, or other matter which is displayed in a seven-inch square in the lower corner of the windshield farthest removed from the driver or signs, stickers, or other matter which is displayed in a five-inch square in the lower corner of the windshield nearest the driver;
(3) Direction, destination, or termination signs upon a passenger common carrier motor vehicle if the signs do not interfere with the driveŕs clear view of approaching traffic;
(4) Any transparent item which is not red or amber in color which is placed on the uppermost six inches of the windshield;
(5) Any federal, state, or local sticker or certificate which is required by law to be placed on any windshield or window;
(6) The rear windshield or the side or door windows, except those windows to the right and left of the driver of:
(A) A multipurpose passenger vehicle;
(B) A school bus, any other bus used for public transportation, and any bus or van owned or leased by any religious or any nonprofit organization duly incorporated under the laws of this state;
(C) Any limousine owned or leased by a public or private entity; or
(D) Any other vehicle, the windows or windshields of which have been tinted or darkened before factory delivery or permitted by federal law or regulation; or
(7) Any law enforcement vehicle.
(d) The Department of Motor Vehicle Safety may, upon application from a person required for medical reasons to be shielded from the direct rays of the sun and only if such application is supported by written attestation of such fact from a person licensed to practice medicine under Chapter 34 of Title 43, issue an exemption from the provisions of this Code section for any motor vehicle owned by such person or in which such person is a habitual passenger. The exemption shall be issued with such conditions and limitations as may be prescribed by the Department of Motor Vehicle Safety.
(e) No person shall install any material upon the windshields or windows of any motor vehicle, the installation of which would result in a reduction of light transmission or an increase in light reflectance in violation of subsection (b) of this Code section.
(f) The Department of Motor Vehicle Safety is authorized to promulgate such rules and regulations as may be necessary to carry out the provisions of this Code section.
(g) Any person who violates subsection (b) or (e) of this Code section shall be guilty of a misdemeanor.∀

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.




MISDEMEANORS IN GA

Definition of a Misdemeanor
A misdemeanor (http://www.ganet.state.ga.us/cgi-bin/pub/ocode/ocgsearch?docname=OCode/G/16/1/3) is any crime other than a felony.

Local ordinances in Georgia are, by definition, misdemeanors, and are tried in the municipal and/or magistrate courts.

Punishment for most misdemeanors is up to 12 months in jail. You can get good time credit while in jail. Many jails only require you to serve half your sentence.

Fines for most are up to $1000, but can be as low as $300 for certain offenses.
Misdemeanors - Other Punishment
In addition to jail, probation, fines, and restitution, some common punishment for a misdemeanor conviction are as follows:

Community Service
Loss of Right to Possess a Firearm
Loss of Federal Financial Aid for Your Education
Precluded From Certain Job Opportunities
Loss of Driving Privileges
Suspension Of License Plate
Publication of Your Photo in the Newspaper



So is your $200 tint job worth any of that?
it is not worth the risk for Most Shops, that applies to the installers too, per offence. Hell naw coming from this way. Been in business to go under over a few side jobs.

i paid a $60 fine and had to remove the tint from my windows back in december cause of this crap. however i knew it was 5% tint when i bought the car and i figured i would have to pay up eventually so oh well...

I got 5% i say fuck the police, they need to realize that there are more important things then my tint like a 15 year old girl being raped, or people robbing people, if i get pulled over i will always roll windows down, maybe not in the rain but why would a cop waste his time on a tint job in the rain, not worth the hassle., i dont like alot light im fragile, When i get pulled over for ruteen checks i rolled windows down and they did not have a problem, cause when i passed them its obvious. i got a buddy thats a cop,he says if they look like there up to no good with it, yeah maybe a ticket but has never gave one out. just my thoughts

I know a buddy of mine fought his ticket and won, took a picture of the paulding co. user cop's car and took it to court..if he doesnt need to remove it hes like why should I

I am not changing my tint.

According to the definition, about the cars that are built for occasional off-road useage. Almost everyones car has some sort of part that is for off-road usage like bodykits and turbos and stuff like that so wouldnt all of our cars be considered multi-purpose vehichles? and some of the newer cars come from the factory w/ dark tint

no car comes from the factory with tint lower that 70%. and body kits and tubros don't meet the standard for "off road"
try something like AWD and you will have a case.

NO, that only a portion of the law applies to you. this part.

(6) The rear windshield or the side or door windows, except those windows to the right and left of the driver of:
(A) A multipurpose passenger vehicle;

meaning that only the windows to the right and left of the driver are regulated to 32%

yeah see I live in dekalb county and some of the cop cars here have limo tint onn the windows they are suppose to abid by the law too. I am not changing my tint.

police care are exempt from the state law. :police:

this does not apply to their privatly owned vehicles and they don't get illegal tint from my shop. for the reason that we have tint law to help protect them and then they want to break the law that is in place for them. NOPE NOT AT MY SHOP.

Police are not worried if a cop has a gun pointed at them from the inside of a patrol car and not being able to see it...it's the civilians that are ready to spray them upon walking up. If you see an officer walk up to a vehicle, any SMART one will keep one hand on the vehicle to push off incase there is gun fire.

i go to court on the 14th and the 21st for tint tickets... one in jefferson and one in houschton. lucky me. but i got mine retinted so hopefully the'll drop it

you have no warranty. NO MANUFACTURE WARRANTIES ILLEGAL TINT. NOT A ONE. so you may have a so called warranty from the shop but I doubt they will fix any problems don't the line for free.

and i wont tint a cops car darker than legal because the damn law is made mainly for them. so i don't do many cops cars:police:
