my friend just got a ticket for 90 in a 65. in gwinnet county. what should he do. he says he wasnt going that fast and the cop didnt radar or laser. it was just an estimate while the police officer was driving. what should he plea as and what should he say in court?? thanks!

At least it wasn't in duluth, the cops can read your mind and find out how fast you were going. That how they manage to show up before anything ever happens, they feel a disturbance in the duluth force.

As far as I know, he's pretty screwed. He could try to find out when that officer last got certified for Speed Estimating (or something like that). I believe that they have to go in every so often and estimate how fast several targets are moving and they can only be off by like 5 MPH or something like that.
Also, were there any circumstances that might affect his ability to determine said speed (i.e. was it raining, foggy, or otherwise low visibility, lots of other cars, etc...). You'd also have to figure out if your buddy was followed for a while, or if the cop was stationary, or if he was going the opposite direction (but honestly trying to figure all that out is a waste of time unless you are really gonna try to fight it the long way). I had my 16 point "Leaving the scene of an accident" reduced to a 2-3 point "Failure to signal lane change" because it was about to snow and I couldn't get a tow truck out to the mountains in time (this was in Colorado).
There are too many things that come into play to give you a definite answer on what to say in court, or what plea would be the best available. Best you can hope for is that he doesn't show up. Also, if you or your buddy is going to college, some schools have a legal department (they won't represent you, but they're a good source of legal info).

damn dude. i got a ticket for doing 93 in a 65 in my 88 hatch 4 speed (yeah come on, its stock too) on 85 north right after coming back from pleasant hill. that area blows. anyway, we left bp after getting gas and we saw the cop bust a u turn at the red light comin gout of the hooters direction ( thus i now knew he was behind me). we jumped on 85 north and bout 2 minutes later, im getting blue lighted. cop was going after my buddy's eclipse then pulled me over instead. all we were doing was going home. i never hit over 75.
anyway, long story short, the gwinnett county selicitor (sp) told me that i couldnt fight the cops word in court so the best thing to do was plead no-lo. pissed me off man. $180 speeding ticket. no radar or any proof either. IMO you need a really good lawyer. :2cents:
tell your buddy good luck and atleast it wasnt duluth PD or gwinnett. they are bitches.

not trying to rape a thread but does anyone know if a pacing ticket is fightable? on my ticket the cop put vehicle as speed detector and put that he was doing 93 and i was pulling away from him. lol. damn. didnt know a 4 speed could pull on a cop.....

well depending on if your buddy is over 21 or not.
If he isnt get a lawyer, well worth it, because you will end up paying close to 1000 depeinding on your record.
If he is over 21 I would still get a lawyer..
and yes the cop estimating how fast your friend was going can be held up in court

cop must have "accurate" laser or radar.
i heard something about them using radars and lasers to help train them on how fast people are going. n thats why it holds up in court.

I am 16, I have a speeding ticket on 316.. I was going 85 on a 55... 30 Over.. And the cop caught me on a laser..
I can bet my ticket is gonna be less than $250.. You only get around $1000 when its Agressive Driving and other bad shit like that, but for a speeding ticket? Nahh bro.. Dont worry.
Im gonna say that my spedometer or how ever you spell it doesnt work.. and i was keeping up with flow of traffic and next thing you know i get pulled over.. Lol

not to bring you down, but you do realize that faulty equipment is illegal too, right? i tried that when i got my ticket for only goin 20 over. didnt do a thing.

I keep reading about speeding tickets in this part of the forum. And Damn its nice that I can't even go faster than 50 on a street and 70 on the highway I am sure I could go faster but with my wheels it just freaks me out so I go slow.

Tell your friend to get a lawyer, it's not the fine from the ticket that kills you, it's the years of raised insurance rates..
To me it's worth a few hundred bucks in lawyers fees if he/she can even get it reduced to a lesser charge (ie less points)..

I think your friend will be okay. i got a ticket in my honde civic (which i dont have anymore) i was going 62 in a 35. I pleaded guilty and i got to keep my license. I had to write a paper,pay $250 and go to classes which cost $75. He could fight it but since he wasn't going that much over i honestly dont think they will take his license unless he has an ass as a judge but i got mine in Monroe county and i got away alright

ok...well if you get one more ticket until you turn 18 your license will be suspened! At least I believe if you get 2 moving violations before teh age of 18 you will get your license suspended! Honestly your ticket might be a little more than what you are thinking!
I have paid 700 for going 22 over! So I wouldnt hold your breath! But you never know!
So good luck with your ticket...and slow down! Not worth losing you license over!

I read somewhere that if u can come up with little excuses like.....ur speedometer being off a bit or something like that it could help ur "fight".....just something I read though.

yea but you kept your licence. his fine is low because you have to pay to reinstate ur license when the suspension is up. and noone come back with naw man my friends brothers license was suspended shit because i lived in gwinnett my whole life, and ive had mine suspended. under 18= suspension for 6 months with ANY accumulation of 4 pts. over 18 but under 21= suspension for 6 months with any one ticket over 4 pts and any accumulation of 15pts. and over 21= 15 pts for suspension
