Alright, I have been out of work for almost 2 months now, I find alot of job openings in my area, and I apply for alot of them, but It seems my background check is holding me up. I have a theft by taking charge, which I received when I was 18, a few friends took the fire extinguisher from my own apartment to play a prank on our room mate, which didnt work and the police ended up coming, and I got theft by taking, I should have fought it, but I was a dumb kid, I did not know how to handle that sort of situation. I also have a underage consumption charge, but I doubt that has any real effect on a background check.(Both are Misdemeanors)

Anyways, I went to the court house, hoping I could maybe get them expunged, I had no idea how that process worked, well apparently you can only get it expunged if you plead not guilty or the case got settled, but 99% of any no lo or guilty plea meant no expungement. I plead, No lo to one, and guilty to the other, and Apparently these charges are with me for life =(.

Most of the places I apply for, is an instant deny, because of the theft by taking, and it is killing my job search. So, here I am, Need some help from the IA community, on where I maybe should look for some place that either doesnt do a background check, or I can explain my situation to. I have Work experience in Roofing, CNC machines, Grocery, Fast food, Restaraunt, fuel centers. So, anyone that can chime in, to aid my cause if finding a job, or advice, would be a great help to me, and I would be very thankful to.

Please no Trolling/Flamming, I know what I did was stupid, but this is a real life problem, and I take it pretty seriously, not having a job sucks.

Thanks in advance guys.

Thanks in advance guys.

only real thing you can do is be honest in person, or contact a place you are applying too and talk to the HR lady/dude/person.

Explain your situation, "hey i just wanted to let you guys know i recently applied for XXXXXXX job. I was told i was having problems with my background check with other job applications because a charge keeps coming up from when i was 18 that really is false , please let me know if there are any questions about my background check".

or something to that fact.

Why didn't u plead youthful offender? I got in trouble when I was 18 and they allowed mento plead it. Everything was removed after my probation. I don't disclose anything and I have insurance and finances license now.

I would guess they would have the same rules as the state court? I have no idea, can you get stuff expunged through them if you plead guilty?

Your lawyer should have asked for it. I knew nothing about it until my lawyer told me.

From my learning in law studies for school the expunge papers have to be signed by local court, state court then GBI, Then last the FBI and FBI has is Expunged...
At some point if anyone refuses to sign it thats it and you can't ever have it done.

So pretty much what it all boils down to is that you have to know someone at each level to get it pushed to the next person/people in line and then you also have to know that person and/or people at that level and so on all the way up to the last person in line. Sounds to me like it is and will always be only the provelaged wh i have that opportunity and option in life if they were to ever get messed up in something like that. No real surprise there.

Are they pulling your background check right away or is that just part of the application process?

It's been a while for me actually filling out an application to work versus putting my resume out there so, do excuse my memory. Have you ever held a job previously that you could maybe throw into a resume format? Any specialized skills you can highlight? Did you work any jobs through out high school like a part time job?

In my experience when starting out, a clean resume with work experience (of almost any kind), education, certifications, special skills (either relevant or irrelevant to the job you're applying to), and good communication skills will typically get in the door enough to where they'd actually ask you what happened with the background check. At which point, you can explain that you were younger and dumber and didn't think how your decisions at that time would affect outcomes today.... that you learned your lesson and you're now focusing on your career, education goals, and forming your character.

Point is, you want to try to get to talk to the person, as Vtekkid said, rather than never have the opportunity to. Either way, good luck!
