A law firm just started calling me from something a while back (i'd say 3-4 years)

Law firm of John Bonewicz

So I had an account which had a balance of ~7500 (long story)

They were threatening me of taking me to court and garnishing my wages, etc.

I offered to settle with a lump sum, after a lot of negotiations lol, they said they could do ~3700...

They keep saying that its the last day and if I don't they'll transfer it to "gwinnett county", they never said courts, but I don't know what they mean by that and when I ask they get all unclear and that they cant discuss that because they don't know.

My question is, should I take the gamble, and let them let it go to "gwinnett" and settle it then?

or should I just go ahead and settle now? I hate dealing with these motherfuckers they're rude as fuck and I already caught them trying to scam me lol... He said he'd settle for ~2900, i'm like lets do it.... he said can I have your bank routing numbers, etc... I'm like no I'll pay debit.. he told me to hold for a second... his "manager" comes on the line all angry like hell no we said 3700, not 2900, and starts getting even more aggressive...

should I bite the bullet?

If you have the funds and the account was 7500, I personally would settle it. See if they can report it on your credit as paid as agreed though. If they can I would just settle.

^ x2 but the guy shouldn't have told you 2900 if he wasn't authorized to do so.

I hear you, but I hate when companies tell you something without actually confirming first. False hope. If you have the money I'd just pay it and get it out of the way..

WHATEVER you do make sure they send it in writing, over the mail!!!!!!

seriously, nothing to play with, they can take your 3700, and then still come after you for the rest... be very weary and cautious. send money order after they send you the settlement letter

THIS. Get it in writing and keep it forever.

Do not give them your access to your bank account under any circumstances.

Why wouldn't you pay them? Do you not technically owe 7500?

seems like a good deal if you can get out of it for only 3700...

I dont know they whole story behind the debt, but if someone owed me 7500 i would get kind of rude as well.

Im not really sure what your getting at...

If you owe someone 7500 and they're willing to take 3700 to settle I dont see where the issue is.

If there's discrepency over the debt then that's a different story, but I didn't see anything about that in the OP.

I agree with Shit tank.

Collection companies aren't hired to be nice. They make their money on what they collect and they deal with people who try to scam the system nonstop. That is their job.

As said above, get it in writing. If you don't and you go to court, the Judge sees someone who didn't pay something for x amount of years with an excuse why, and a company saying he tried to get away with paying half.

I havent incurred that much debt yet. But when I got little harrassing calls for my little $300 I "owed" Wachovia 4 yrs ago. I just blew them off, I moved 4 times and finally settled for $90. Since the reasoning was that I put 3 regular criminals behind bars for them.

But in your case, (not knowing the full details behind it) I would ride it out in court, if the reasoning you believe is strong enough to hold and u have records of the incident and can prove a just cause. I would be believe a Judge would rule in your favor since the economy is in distress and its quite hard to pay for things that are considered "extra" at this time. Then neg while in court (if possible) with that company. Or just drag it out for 3 more good yrs, write-out season is lookin kinda nice.

Then come back online and neg rep Simon and Got Milk! and jdm_civic and probably Sammich, since he's just "hangin out."

yes do not give them access to your account, ensure you get everything in writing, that they are willing to settle for that amount, and read the letter carefully to ensure theres no loopholes... also as the guy said before, i would pay them with a money order, try to avoid any direct contact with your bank account but if you have the money to settle for said amount now, i would do it.. after all you do owe them over 3000 more than what youre settling for so i wouldnt push my luck because you may end up payiong everything plus additional fee's and it would be taken out of your wages.

yeah I ended up settling,

I just paid it off, one less stress on my chest now.

I got everything in writing, etc. Getting a zero balance statement in 30 days, and I made sure they couldn't sell any part of the debt to any other company etc.... I did a little homework and asked a few people if it was legit, which it was...

thanks for the help guys
