i don't know if this is the right section. if not, can you please move it.
Well, i was speeding 65 on a 55. but the cop had pulled me over in the 45 saying i was going 65. so i had a ticket for that.
In August, i had cancel my insurance, and i guess they suspended my tag because i didn't returned it to the tag office. Well, in September, i got insurance with a different company, and a couple of weeks later, the tag office sent me a notice paper saying that my tag has been suspended and for me to call my insurance. So i had called them, and they said it was ok. Well, i drove my car for about two months, got pulled over and got a $700 ticket for diving with suspended tag.
Well, it's a big misunderstanding because at first, i cancel my insurance at premier insurance in August, and got new insurance in septemeber. And they had sent me the notification in september and i thought it was my current insurance. Does it make sense? if not, i can add more details.
What i'm asking is, if i fight for it in court, is there a chance i might win. Cause how can i get insurance with my tag being suspended.

coming from someone that had a suspended tag before for the same thing. You can fight it but I think you will lose. The tag office sends you letter after letter before they suspend your tag and registration. They sent me two then one saying it had been suspended. To be honest with you it will cost you more to hire a lawyer and fight it then just pay it and be on your way.

The only misunderstand, as I see it, is on you, man. When you canceled the insurance on your car in August and you did NOT go to the tag office to cancel the registration, you were assessed a tag penalty of $25. After 60 days (I believe it is) has passed without you going up there to pay the $25 fee, there was another $65 fee tacked on for a total of $85 for failing to keep your car insured. Now since you never paid the tag fees, your tag stayed suspended. Even when you got insurance, you still had a suspended tag. It was still on you to go to the tag office and pay the $85 fee to reinstate your tag. The reason why your insurance agency was saying it was ok is because they were telling you that your insurance was ok. Not your tag situation.
Anytime you cancel insurance on a car, FOR WHATEVER REASON and for HOWEVER LONG, you have to go to the tag office and cancel the registration.
Hope this helps. I don't see you having a case at all. Later, QD.

Trust me man quickdodge is right. This same thing happened to me with the exception I was never pulled over. When I went to renew my tag that was when they told me that my tag was suspended. What quickdodge said is true. It starts out with $25 then after 60 days they add $65. Your insurance it fine but the tag is not. This is controlled by two different agency's. Not to mention the way the tag office found out was your insurance company notified them, by law. You say your ticket is $700 plus the $90 at the tag office for a grand total of $785, maybe some court fees also. I may be wrong on this but I do nothing your going to find a lawyer that will take this case for less than $1,000. Then your still going to have to pay your ticket and tag fees. I am not the smarted person in the world but I would say just pay it. Go to court pled Nolo if you have not pled it in the past 5 years and pay your fines and be done with it. Fighting it is going to cost a whole lot more. Unless you just have a ton of money just lying around, if thats the case I'll take some. lol

It's not seen that way by the officials. You're supposed to know this stuff. Trust me as I went through the same thing. That's how I know now.
but when i went and insured at a new insurance, shouldn't they be telling me that my tag is suspended.
No sir. Insurance companies are opposite of tag offices. They don't care if your car is running or if you drive it or if it's even tagged at all. As long as you have insurance. The only thing the look at is validity of your driver's license.
Like i said, they sent the notification when i had new insurance and i thought it was that current insurance that had cancel my tagg. i already paid the fee.
The reason this happens is when you cancel with an insurance company, that company reports that to the state of your residence. You have a window of about 24 hours to get new insurance or the gap will be officially "illegal." This will cause your registration to be suspended.
So you say you already paid the $25 fine? Then this is what I think is going on. The $25 fine you paid was just the fine amount owed because you didn't cancel the tag. That didn't actually reinstate your tag. Your tag is still canceled until you go up to the tag office and reinstate it yourself, showing new insurance. Your tag WAS still suspended. There is no case. Later, QD.

If you haven't been up there since you got insurance with Esquire, then no, you haven't gotten your tag renewed. You can't reinstate a tag if you have no insurance. Later, QD.

I don't know if you can plead a nolo for a tag offense like that, but I'm not sure. This is a question I can't help you with. Sorry. Later, QD.
