My uninsured, unregistered, untitled EF hatch has been hit with a tree as it was parked at my apartment complex parking lot.
the windshield, rear view mirror, and driver's side window were broken.. the roof was also dented.
Is this a problem i could be reimbursed for these damages through my apartment management?
I dont really care as I havent invested much in the car.
but i dont think it's right that they can have a tree fall on my car and not pay for the damage.

Apartments don't have anything to do with your car. And tree falling down is not their fault, it's god doings.

the office is closed.. i stopped by after i saw it..
and they did give me permission to park my car there. knowing it's unregistered, unlicensed and uninsured.

they should maintain the grounds and take care of any trees that might be about to fall. i wouldnt think a perfectly healthy tree just fell.

I'm pretty sure they're gonna say you should go through your own insurance company.
LOL, wait....

it's not my fault.. if i did have insurance on the car in the first place, i wouldnt go through them either..
like if someone wants to settle a fender bender without going through insurance to keep rates down.

i dont think they are liable since in my apartment contract it said that they arent responsible for vehicles parked on property
Humphrizzle

they arent responsible for other's actions done to cars.. but when their own property damages something i own, i'd say it's their fault.

i only check on the car like once a week.. i drove home and noticed the window was down.. thought someone had stolen some shit out of it or something..
but i drive closer and see a 8 food piece of tree on the ground and a busted windshield and driver's window.
sucks..

It's their property yes, but it's your duty yo insure your car. Also, if you had insurance on your apartment, there might be a slight chance they might cover.

they probably wont give you shit. if it does go throught there insurance or your insurance and there is no proof you even own the car because its "untitled" once they find that out and they will. tell you to get lost! and have a nice day!

bill of sale is enough for ownership.

so if i have a child playing in the middle of the parking lot and a tree falls on them due to poor lawn maintenance, the apartment would not be liable?
As I have said before, it's not my fault the tree fell on my car. so even if the car were insured, i would not go through my insurance to skyrocket my rates.
This should be an apartment problem. saftey hazard.
Ex.2
If my apartment was hit by a tree during a rain storm, leaving the window bashed in and shorting out my television, this would also be a problem for the property manager. poor maintenance = not my fault. I pay 650 a month to live in a safe neighborhood and it's not living up to the normal standards..

negative.

do you have this in writing? if not, you cant really prove they gave you permission IF you were to take it to court
I'm pretty sure they're gonna say you should go through your own insurance company.
the probable response
this is what you should expect to see when you bring it up at the leasing office:

it's not that big of a deal.. i'll bring it up to my apartment manager, if they say they cant or dont want to right the wrong.. i'll just have a dented car i'll be parting out.
just thought it was an interesting idea. and wanted to know real information on what i could do or was entitled to for the damages.

have you ever been in the situation at hand? have you ever asked someone to repair a car that their tree fell on?
if so, thanks for the advice..

Your not gonna get anything.
Your car is not insured.
They don't own the trees.
Just as if there was a storm and the tree fell down and hit your car.

a tree on someone's property is part of their property
property is owned by the apartment.
dont see your theory of "they dont own the trees" when they DO own the trees.

A tree limb fell off a neighbors tree and hit our fence and roof, putting a hole in it. They had to pay to fix it (them or their insurance, don't remember which did), because the tree was their property since it was on their property and it should have been trimmed. Apartment property might be different, but I still believe it should be the property owners job to take care of lawn maintenance, because you don't own the lawn they do. Every apt I have lived in, the landlord sends yard people around once a month to do the grass and trim bushes and stuff.
Just saying this is my personnel experience with it. I would check with someone other than the property owner first just to make sure he don't try to screw you over or tell you its not his fault.

Have you owned the car longer than 30 days? If so, they will question you as to why you have yet to title the car under your name during the allotted 30 day window.

My uncle happens to be one of the managers there...you're not getting shit, you said you don't like the car.
Naw but really you won't get jack shit. Car isn't insured. Car isn't registered. Do you even have proof it's your car? You aren't getting anything, sorry.

Why should he pay for something that is on their property and their responsibility to maintain?

A. It's not insured or registered.
B. He asked to put it there.
C. A tree falling usually shouldn't mean they should pay for it.

Not being insured or registered shouldn't matter. I mean if it doesn't run or is not legal to be on the road...whats the point in that?
They let him put it there yes....not like he just parked some shitty car wherever he wanted.
If its on their property, they should be responsible for the upkeep and it randomly falling or losing a branch means they were not doing what they should be. Im pretty sure its the same as if your neighbors tree fell on your house when it was not in the middle of a storm or something natural that cant be helped. We had a tree limb fall on our house from the neighbors yard once....they had to fix the house...was around like $15,000 worth of damage.

car belongs to me. i have proof of ownership. i've spent near 200 dollars on the car and to have a tree fall on it to make it worth nothing... reinbursement would be ideal.
