I know I am in the wrong... I need some advice. It was raining and heavy traffic, i didn't realize the school bus was 2 lanes over on the right shoulder until I was right beside it. I don't remember if it had it's stop sign on or not. I was just paying attention to the car ahead of me due to the rain and traffic. I know passing a school bus, packs 6 points on your DL. I have a clean driving record, and I need to know what kind of options I have. Lawyer? nolo? anybody know of a good traffic lawyer for the Duluth area? thanks!

I dont think theres much you can do. A mistake is a mistake, pay the fine.

wow u got an actual ticket for this???? Never heard of anyone getting one IRL. But just like my current suspension, u will have to ride it out and just deal with it. Pay it and go on.

You need a lawyer cause no matter what you do your gonna take it in the ass, but the options you have are to get a lawyer ( Lube) or no lawyer ( with sand paper).

If I am not mistaken it is an auto year suspension, and one hell of a fine, and Ga is a no joke state about this.

Well, now I know. I happen upon a 1yr suspension due to me moving alot. Missed out and rolled around for 2 months on a suspended license, got stopped and NOW its 1 yr. But, I'll make due.

according to the master list of offenses for Georgia courts, it is a misdemeanor, though the site I found does not list specific penalties.

If you are over 21 years old, it'll just be 6 points and $1,000 fine. You will be required to show up to court as they won't let you pay that ahead of time. If you accumulate 9 more points in the next 23 months, you'll be issued a license suspension. Later, QD.

QD speaks the truth,with it being a school bus your kinda in a rough spot and to be honest i would keep the nolo plea just incase you get another ticket later on and you need it...i mean if your a minor you could ask the judge to be leniant and he might cut you a break on the fine or number of points that goes on....ive done it before and the judge was actually really understanding....best of luck to you :goodjob:

go to court and plead nolo, it may get you off the hook with the points since you dont have anything in your driving record, and then the judge is going to tell you what the amount of the fine is going to be, and right after, he is going to ask you if you wanna say something, just say yes and pop the magic question "may i ask for a reduction on the fine?", if he grants it, thats a 25% off the fine.
ive heard this about 3 years ago when i had to show up to court due to a ticket that got dismissed.
and then tried 6 months ago in gwinnett for a speeding ticket (67/35mph= 6 points) and worked!!! i pled nolo, so no points, and got the fine reduced from 165 to 125, thats 25% off.

i know that a speeding ticket is not the same offence as passing a school bus, but give it a shot.

It's not anything close. The OP's ticket is very much a no-no in the court's eyes. They don't too much waiver on this offense. So you can't even compare speeding ticket with other offenses. Later, QD.

points is a bitch when passing a school bus they are the highest of points ...

I think they are 6 or 7 points on your record. just as bad as wreckless driving.. sounds you're going to need some luck on this one. But you was in the wrong like you stated.And I hope there is no mercy due to so many kids getting killed over people that has done this in GA.

I have actually gotten the same ticket when I was 19 in lake city, ga. its a bad one to get as far as the points are concerned, but I dont rememeber the fine being anywhere near $1k. I think my fine was $300 maybe close to $400. have you called to get a price??
also, pleading nolo may save you points, but its all up to the judge if he allows you too.

of course this all happened 6 years ago, so I dont know whats changed since I got my ticket. Good Luck with it all.

My lawyer has gotten me out of countless driving violations (back in the day) he used to be a county prosecutor. Let me know if you want him name and number, but dont call him if your not serious.

Disobedience of any traffic-control device or traffic officer: 3 points


Possessing an open container of an alcoholic beverage while driving: 2 points


Failure to secure a load: 2 points


All other moving violations: 3 points

Child restraint (second and subsequent offense): 2 points

so you were following the car in front of you right or paying attention? did they stop, did the cop get them? why not? if you were paying attention why didnt you see the big yellow bus? what if a kid had been walking across and you hit them and killed them?

i had this same ticket around december 2 years ago... this is exactly what happened... as soon as i was able to call and find out how much my ticket was i got told it was going to get suspended... so what i did i went to the defensive driving class and got everything done early so i wouldnt even come to a problem when my court date was close... when i was in the courtroom my name was called and i got sent to this little clerk... gave her my name and information... she said i was there for unlawfully passing a school bus... so i said what i can i plea? she said u cant plea nolo cause ur not over 21 and u cant plea guilty for the same reason... i was like ok??? so what do i do... and she was like well im going to give you (x amount of hours) of community service... go seat over there and ill call u back up here... when she called me back up there she said... "i made a mistake and since u already have traffic violations u are just going to get ur license suspended for a year" thats all.

so if its true that u dont have anything on ur record u might get away with community service... ohh and my ticket was 300 and some change.

Two questions. 1 was this a four lane road. 2 were you going in the same or opposite direction of the school bus.

pleading nolo to any offense that carries an auto suspension will keep you from getting your license suspended. talk to the solicitor when you go to court just to double check.
