View Full Version : Need to know some things about the laws..

I recently sold my Trans Am, which had a rebuilt title, to a guy from Miss. I get a call this morning from someone which i have never spoken to about the car. He wants me to pay $425 to get the front end fixed on the trans am, which i never had a problem with. I talk to the guy a few times and he says he's a covington police officer and he's going to have a warrant for my arrest and a whole bunch of other things. He then tells me that he had the car looked at for the guy who bought it from me. Now all along i have no idea who this guy is, just that he looked over the car for the guy who purchased it from me. I dont know if this guy is related to the one who bought the car or what. But he keeps bringing up the " Lemon law" and that he has 72 hours to return the car to me. And also i told the guy who bought it all along that i had a Georgia certified title, this other guy even agreed to that. So now he's supposed to be bringing up a suit against me and i'm just curious. Can anyone help me out here?? Thanks!!

Pretty sure the lemon law only applies to dealers. When you sell a used car with no written agreement seems like it would be as-is. They could take you to small claims court, but on what basis? Pretty sure the car will have to be inspected by the "buyers" state before he can get a title there.

Exactly what i thought! On the bill of sale i even wrote that the vehicle was in as-is condition.

I googled and it says they can do small claims, but that was on a repair bill. Guessing the guy can't get a title in Miss.?

He shouldnt have a problem getting the title since it's not salvage. If anything it should only have to be re-inspected. But throughout the whole thing, i told him it was a Ga. certified title.

I've found this online, specific to Georgia. and that clearly says no lemon law. And that's even towards dealers.

Lemon laws do apply to used cars from dealers if it has a remaining factory warranty, I had a s-10 with trans. issues that it applied for.

The car wasn't in bad shape at all. He tried to tell me it needed the whole damn front end rebuilt. but yeah, the black one with the Boyd Coddington's.

how long has it been since it was sold. me id say they are fucked as is bitch. should have done a full inspection before purchase.

yeah its definitely as-is. i sold a car to a lady down here that was a fine car but i sold it very cheap just to get rid of it. anyways something was wrong with the subframe a week later after she bought it. hated to tell her but it wasnt like that when i sold it to her and its as is. she filed police reports and she gave up. my lawyer which is a family friend said i had nothing to worry about.

Early yesterday. And they did look it over and all. Even took him for a ride in it.

as far as i know lemon laws are for new cars.... even used car dealerships dont worry wbout the lemon laws. my friend bought a cavalier that HAD a blown head gasket..... fucking thing overheated on the drive home..... aparently it didnt when test driving it. they would not do anything for them but just told them their next payment date.....

used cars are as is

the state of ga has no lemon law uve got nothin to worrie about dont mean to sound like a dick but the prick shouldve looked at the car a lil harder treat them like a bill collector and start forwarding there phone calls lol

if it has a rebuilt ga title then it has been inspected and is a clean GA title which should go to any state, not just anyone can salvage a car. i don't think you have much to worry about. the dude prob screwed it up himself and is looking for a way out. i checked into this recently on a civic my girl bought.

It doesn't matter if its rebuilt or not its a Civil Court matter, tell him to sue you.

then you should have no legal actions brought upon you. your bill of sale states what the car was sold as and the buyer has signed that bill of sale.

Lemon law does not have shit to do with you selling a used car with a rebuilt title.

the guy is stupid and misconstrued all his laws and is trying to get some money out of you.

if taken to small claims court, countersuit for time lost from missing work or something.

If the guy claims he is a Covington police officer, record the calland get his name and badge number. If he refuses to give it to you, he is a liar who is now guilty of impersonating a police officer - keep the recording for use in court, and if you have the guys real number, file a police report. If he gives you a badge number, call the Covington police department,, ask for him, and when they forward you to him, sinply say, "Now I know where you work.", and hang up.

Legally, the car was sold as-is, where-is, and lemon laws do not apply to this vehicle. His only legal option is to attempt to sue you in magistrate court, but he shouldn't be able to win based upon what little info you have posted.

if the guy is claiming lemon law then he is full of it on a used car, it clearly says rebuilt on it and it's a clean Ga title. i have a friend at the tag office i will prob be seeing with my g/f since we need to tag her car.
